대북 전단살포 문제 연구 (Study on Issue of Aerial Leaflet Dissemination to North Korea)

초록

최근 남북한 양측이 상대 지역에 전단을 살포하거나 쓰레기풍선을 보냈다. 이로 인해 여러 가지 문제가 발생하고 있다. 이 논문은 전단 살포와 관련한 법제도와 판례의변천을 살펴보면서 해결방안을 찾아보려는 시도다. 먼저 대북전단살포의 실태를 살펴본 후 이와 관련한 법제도의 형성과 변천 그리고 판례를 검토하면서 장래의 대응방안을 논의하였다.
전단살포는 남북분단으로 인한 갈등이 드러난 상징적 사건이며, 남북한 사이에서발생하는 사건이라는 점에서 통상의 기본권이 남한 사회 내에서 발생하는 문제를 다룬다는 점과 구별된다. 이 문제는 헌법 차원에서 고려해야 한다. 평화통일을 추구하는헌법정신의 구현과 행복추구권, 대북전단살포를 하려는 사람의 표현의 자유, 북측의대응조치로 인한 접경지 주민의 안전보장, 쓰레기풍선으로 인한 전 국민의 안전 문제및 이들 기본권 간의 충돌문제가 전체적으로 고려되어야 한다. 향후 대북전단살포를규율하는 법률을 개정할 경우의 입법방향에 대한 검토도 필요하다.
2000년 이후부터 민간단체가 대북전단 살포를 주도하였고, 대북전단살포는 북한체제와 지도자를 비판하여 내부 저항을 유도하는 것을 목표로 한다. 심리전의 수행장소가 상당부분 사이버 공간으로 이전된 현대 심리전의 흐름과는 다르게 대북전단은 재래식으로 유지되고 있는 특성이 있고, 남한에서 보내는 대북전단의 효과는 명확하지 않은 편이다. 효과도 명확하지 않은 대북전단 살포로 인한 부작용은 남한 주민의 안전에대한 위협으로 직접적인 침해다. 표현의 자유와 안전권 등 기본권이 충돌할 경우에는생명권 등 보다 상위의 기본권이 우선적으로 보호되어야 한다. 규범조화적 해석을 하더라도 헌법상의 평화통일목표 실현 책무와 행복추구권이 전단살포를 통한 표현의 자유보다 더 강조되어야 한다. 효과도 불명확한 대북전단살포를 방치함으로써 피해가명확히 예상되는 상황을 방치하는 것은 국가의 안전조치의무 위반이다. 국회는 헌법재판소 결정의 취지를 존중하여 남북관계발전법을 개정해야 한다. 이때 고려할 사항은앞서 본 법리적 내용뿐만 아니라 대북전단살포는 상호비방금지라는 기존의 남북합의에 반한다는 점과 남북한 국력 차이가 60배로 벌어진 현 상황에 바탕하여 국력이 앞선남한이 선제적으로 대북전단살포를 금지함으로써 상호존중의 정신을 실천하는 것이통일로 가는 효과적인 방향이다.

영어초록

Recently, both South Korea and North Korea have dropped propaganda leaflets or trash balloons to each other. The leafleting has caused various problems. This paper attempts to find a solution by looking at the changes in legal systems and precedents related to the leafleting. First, I examined the actual state of leafleting, and reviewed the establishment of, and changes in, the legal systems and precedents, and discussed relevant countermeasures.
Given that the leaflet dropping is a symbolic incident revealing conflicts arising from the division between the Koreas, this issue is distinguished from any other event where fundamental rights generally concern issues arising within South Korean society. This issue should be considered from a constitutional perspective. Issues to consider as a whole include the realization of the constitutional spirit pursuing peaceful unification, the right to pursue happiness, the freedom of expression of those who intend to disseminate leaflets, security guarantees against North Korea's responses, the safety issue of the entire nation arising from trash balloons, and the conflict between fundamental rights. How the law regulating leaflet drops will be amended should be reviewed as well.
Since 2000, non-military organizations have led leafleting to North Korea, and its purpose is to criticize the North Korean regime and its leaders to induce internal resistance. Unlike the trend of modern psychological warfare, where most of warfare venues have been moved online, characteristically, the traditional leafleting method has been maintained, and the effect of the leaflet drops by South Korea is small. The side effect of this less impactful leafleting to North Korea would be direct infringement on the safety of South Korean residents. In the event of a conflict between fundamental rights, such as the freedom of expression and the right to safety, the higher fundamental rights (such as the right to life) should be preferentially protected. Even in the context of harmony with norms, emphasis should be on the duty to realize the goal of peaceful unification and the right to pursue happiness under the Constitution more than the freedom of expression through the distribution of leaflets. It would be a violation of the state's duty to take safety measures to neglect a scenario where neglecting leaflet dropping with unclear effects will clearly lead to damage. The Development of Inter-Korean Relations Act should be amended respecting the Constitutional Court's decision.
Given not only the legal principles examined above, but also leaflet dissemination’s inconsistency with the existing South-North agreement prohibiting mutual slander, and South Korea’s current superiority over North Korea by 60 times, it would be an effective direction toward unification for South Korea, the much advanced state, to put into practice the spirit of mutual respect by preemptively prohibiting the leaflet dissemination.
