초록

《민법전》에서 녹색원칙을 기본원칙으로 삼는 것은 중국의 환경보호와 자원이용의 중요성을 보여주는 것으로, 생태문명 건설 과정에서 중요한 조치이다. 녹색원칙의 확립은 환경보호 문제에 대한 민법의 대응으로써, 민법의 사회화와 공사법적으로 현재의 생태위기에 공동 대처하는 발전이념을 잘 나타내고 있다. 그러나 이 원칙은 구체적인 법적 사실을 지향할 수 없고 법적 효력이 없기 때문에, 민법전 각 분칙에서 구체적인 규칙으로 전환시켜야 그 역할을 수행할 수 있을 것이다. 물권법은 물적 권속을 명확히 하고 물권 행사행위를 규범화하는 기본법률로써, 녹색원칙에 선제적으로 대응하여야 하며, 물권법 규칙의 설립과 개정을 통해 물권법이 사법적 성격을 유지함과 동시에 더욱 친환경적으로 개선되도록 해야 한다.
녹색원칙이 물권법에서의 실현은 본질적으로 기본원칙의 통솔성에 달려있으며, 《민법전》이 생태문명시대의 특징에 대한 중요한 표현이기도 하며, 물권제도 고유의 효율적인 실현 메커니즘에 힘입어 녹색발전 이념을 실천하고 생태문명건설을 촉진하기 위하여 확고한 사법 규범의 기초를 제공한다. 본문의 의의는 녹색원칙에서의 물권법 기본함의에 대해 논술하고, 녹색원칙을 시각으로 하여 기존 물권법 중에 존재하는 부족 부분을 살펴보고, 녹색원칙의 물권법상의 현실 방안을 제기하고, 자연자원소유권제도, 상린관계제도, 용익물권 등의 제도를 개선하는 데 있으며, 나아가 자연자원과 생태환경 위기에 대한 사법제도의 반응을 실현함으로써 민법전의 시대적 특색을 보여준다.

영어초록

The incorporation of the green principle into the basic principles of civil law reflects the importance from China, which attaches to the protection of the environment and the rational use of resources and is one of the important initiatives to promote the construction of ecological civilization. The establishment of the green principle is a civil law response to the issue of environmental protection and fully reflects the development concept of socialization of civil law and public-private law dialogue to jointly respond to the current ecological crisis. However, since the principle cannot be directed to specific legal facts, its legal effect is weak, so it needs to be transformed into specific rules in each division of the Civil Code in order to play its practical role. As the basic law that clarifies the ownership of things and regulates the act of exercising property rights, property law should take the lead in responding to the green principle and make property law more ecological while maintaining the nature of private law by establishing and transforming the rules of property law.
The implementation of the green principle in property law essentially depends on the unifying nature of the basic principles and is an important demonstration of the characteristics of the era of ecological civilization in the Civil Code. With the efficient realization mechanism inherent in the property rights system, it provides a solid foundation of private law norms for practicing the concept of green development and promoting the construction of ecological civilization. The significance of this paper is to elaborate the basic meaning of property law from the green principle, and examine the deficiencies in the current system of rules for property changes in China with the green principle as a vision. This study propose a realistic solution of the green principle in property law, and improve the system of natural resources ownership, the system of neighboring relations, and the system of usufruct. This will enable the private law system to respond to the crisis of natural resources and ecological environment and show the characteristics of the times of the Civil Code.
