전․의경 특채의 허용과 그 문제점에 관한 연구 (Study on permission and the problem for special recruiting of combat and duty police officers)

초록

경찰사무를 수행하는 경찰공무원의 확보는 경찰서비스의 성패를 좌우하는 요인이라 할 수 있다. 경찰공무원의 채용은 신규채용, 공개채용, 특별채용으로 나누어지는데, 최근 경찰청은 치안의 최일선에서 집회나 시위에 대비해야 하는 전의경에 대한 사기 진작이 필요하다며 전의경 전역자를 경찰관으로 특별채용하고 있다. 그러나 이러한 특별채용제도는 비전의경 출신자들과의 형평성 문제, 여성 및 장애인에 대한 상대적 차별 등 기본권에 관련된 문제점들이 나타나고 있다.
이에 전의경 특별채용의 적법성 여부에 관한 고찰은 매우 중요할 것이며, 경찰공무원의 전문성을 확보하기 위한 교육제도의 개선의 필요성 또한 중요하다고 할 수 있다.

영어초록

Securing police officers carrying out police jobs is believed to be a critical factor affecting whether service of police is successful or not. Most important thing in managing and operating police organization is believed to be active and scientific human resource management.
More specifically, attaining competitive human resource is a major factor determining the future of organization and human-oriented managing strategy is necessary to achieve goal of organization to be pursued.
Provision 3 of police law specifies “police has its goal which protects people's life, body and their properties and prevents, settles and investigates crimes, and collects information of investigation and public peace, controls traffic and maintains public security and orders” For these reasons, our police performs new recruits of police officers by open recruiting and special recruiting respectively. Especially, from this year National police agency performed a new policy that is a special recruiting of police officer from people who have finished their military service as combat and duty police officer as it is necessary to enhance morality of combat and duty police officers who have to confront with front line of protests and political rallies, and it published first successful candidates for the first time this year.
Given that new recruiting for police officers is decreasing and there is unfairness from people who finished their military duties by other military groups than combat and duty police officers and people who are students majoring police-related curriculums and women candidates for preparing test for would-be police officer, complains for lawfulness and necessity for special recruiting of combat and duty police officer has been claimed.
Therefore, this study intends to check necessity and lawfulness for special recruiting combat and duty police officer, and to propose its improvement.
