우리나라 공인탐정제입법화에 관한 연구 (A Study on the Legislation ofLicensed Private Investigators in the ROK)

초록

우리나라는 지난 1999년 국회본회의에 상정되지는 못하였으나 ‘공인탐정에 대한 법률(안)’ 입법을 처음 시도하였다. 이후 20년이 지나고 있는 가운데 탐정제와 관련한 법률안 10건은 철회나 임기만료로 폐기되었으며, 2건은 계류 중이다. 미래일자리창출과 공권력의 한계를 극복하고 국민의 권익을 보호하기 위해 국회에서 13차례나 입법안이 시도되었음에도 불구하고 업무범위에서 오는 사생활침해 등의 부정적인 견해와 주무관청 설정의 대립, 기존법률과의 충돌 등으로 법률안 통과에 난항을 겪고 있다. 이에 우리나라는 OECD 가입국가 중 유일하게 탐정제도가 없는 국가로 모든 사건을 수사기관에 의존하고 있어 치안 및 개인간의 다툼이 원만하게 해결되지 않고 있다. 이런 개인간의 분쟁이 다방면으로 다수 발생되는 시대적 흐름 속에 공권력에 의존하지 않고 합법적인 절차에 원만히 해결할 수 있는 공인탐정제도가 시행된다면 사회적으로 분쟁에 소요되는 시간 및 비용을 줄일 수 있을 것으로 기대 된다. 아울러 공인탐정제도가 시행될 것을 대비하여 대학 및 대학의 평생교육원 등 고등교육기관에서는 탐정전공과정을 개설하여 운영하고 있다. 이와 같이 학계와 정부부처 및 관계기관에서는 공인탐정제의 필요성 및 효과를 논의하고 분쟁요소를 해결하여 국회에서 ‘공인탐정제 법률(안)’이 조속히 통과되길 바란다.

영어초록

The ROK first attempted legislation for the first time in 1999 in the ‘act(draft) on licensed private investigators' although it did not pass the plenary session. Twenty years have passed since, 10 legislative bills related to the detective system have been abolished due to withdrawal or term expiry and two cases are pending. Despite the fact that legislative proposals have been made 13 times in the National Assembly to overcome the limitations of future job creation and public authority and to protect the rights and interests of the people, the confrontation between negative views such as the invasion of privacy and the establishment of competent authority and conflict with the existing laws are causing difficulties in passing the bills. Therefore, the ROK is the only country among the OECD countries that does not have a detective system and all cases rely on the investigative agency, which causes difficulties in resolving problems in public order and personal disputes. If a licensed private investigator system, which can solve the legal process without any reliance on public authority in such a time where various personal disputes can occur, is implemented, the time and cost for social disputes will be reduced. In addition, in order to implement the licensed private investigator system, higher education institutions such as universities and university lifelong education institutes will have to establish and operate majors related to private investigators. Therefore, this study hopes for the passing of the ‘act(draft) on the licensed private investigators' in the National Assembly as academia, government ministries, and related agencies discuss the need and effect of licensed private investigators and resolve controversial factors.
