자치경찰제 도입의 법적 쟁점과 과제 (The legal issue of introducing a autonomous police system)

초록

공공의 안녕과 질서의 유지는 행정이 효율적으로 이루어지기 위한 가장 기본적인 요소이자 전제가 된다는 점에서 자치경찰제도는 지방자치의 형식적이고 제도적인 완성이라는 의미를 가진다. 그러한 이유에서 지방자치제도의 본격적 실시 이후로 자치경찰제의 도입에 대한 논의가 빈번하였고, 이에 따른 법제화의 시도 역시 끊임없이 있었으나, 그때마다 여러 가지 사회·정치적인 이유로 번번이 좌절되었다가, 2020. 12. 22. 경찰법의 전부개정을 통해 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」이 국회 본회의를 통과함으로써 자치경찰제가 본격적으로 도입되게 되었다.
지방자치단체의 관할 구역에서의 공공의 안녕과 질서유지는 전형적인 공간적 요소로서 지역과의 관련성을 가지는 사무이며, 특히 지역에서의 치안 및 질서 유지는 지방자치단체의 다른 행정작용, 가령 복리사무의 수행을 위한 당연한 전제인 점에서 자치경찰사무는 규범적으로 볼 때 지역적 사무로서 자치사무에 해당한다고 보아야 한다. 따라서 자치경찰제도에 대해서는 지방자치와 동일하게 소위 전권한성 및 자기책임성의 보장을 통한 자치권이 보장되어야 한다는 것은 당연한 규범적 요청이다.
그럼에도 현행법상 도입된 자치경찰제는 규범적인 이념형 자치경찰제도와는 거리가 먼 것으로, 여전히 국가경찰조직을 전제로 단지 자치경찰사무만을 수행하는 형태로서 경찰권의 ‘분산’일 뿐 ‘분권’이라고 하기는 어려우며, 한편 자치경찰사무에 대한 권한과 감독도 지방자치단체가 아닌 시·도자치경찰위원회에 있는 등 자치경찰제도를 통한 지방자치의 본질과 이념의 구현에는 한계가 있다.
다만 경찰작용은 일반적 행정작용과 다른 특성을 갖는 동시에, 우리나라의 오랜 국가경찰의 역사적 경험 및 현재의 열악한 지방재정의 현실 등을 통해 볼 때, 급진적이고 이상적인 자치경찰의 도입이 우리 사회에 가져올 혼란과 문제점에 대한 우려도 적지 않은 것이 사실이며, 그러한 측면에서 현행법제상 도입된 자치경찰제는 이상적 자치경찰제의 도입을 위한 과도기적인 변형적 형태라고 보아야 할 것이다.
결국 우리나라 지방자치의 열악한 현실에서 자치경찰제를 도입하기 위한 고육지책의 결과물로서, 최선은 아니지만 차선의 노력이라고 본다면, 향후 자치경찰제도의 운용에 있어 현행법제 하에서 자치경찰제의 이념적 실현을 위한 한국형 자치경찰로서의 제도적 정착을 위한 노력이 현재의 중요한 과제라고 생각된다. 그러한 방향성은 당연히 지방자치의 본질적 이념인 주민의 참여를 최대한 보장하는 민주주의적 관점에서 주민의 치안수요에 최대한 부응하는 것이어야 하며, 이를 위해서는 포괄적 위임의 법리를 통해 조례제정권을 최대한 보장하는 등 지방자치의 규범적 원리가 최대한 보장되도록 하는 것이 필요하다.

영어초록

The autonomous police system means the perfunctory and institutional completion of the local government system, because maintaining order in society is the most basic premise for administration to be efficient. For this reason, discussions on the introduction of the autonomous police system have been frequent since the full-fledged implementation of the local government system, and attempts to legislate have also existed constantly. Nevertheless, legislation was repeatedly thwarted for various social and political reasons, finally, by passing the National Assembly the Act on the Organization and Operation of National Police and Autonomous Police on December 22, 2020, the autonomous police system was introduced in earnest.
The maintenance of security and order in the district of a local government is a typical spatial element, which is related to the area, and therefore, the local police affairs are local affairs and should therefore be regarded as autonomous affairs in the eyes of local laws. Therefore, it is a natural normative request that autonomy should be guaranteed for the autonomous police system through the so-called guarantee of full authority and self-responsibility, just like local autonomy.
Nevertheless, the autonomous police system introduced under the current law is far from the normative ideological self-governing police system, because it is only in the form of affairs that local police affairs is carried out through still the national police organization, it is only a "distribution" of the police authority, and it is difficult to call it "autonomous.“ However, it is true that police action has different characteristics from general administrative action, and also the poor reality of local autonomy in Korea is inappropriate for the introduction of radical and ideal autonomous police system. In that respect, the autonomous police system introduced under the current legislation should be seen as a transitional variant considering the reality of Korea, which is a process for the introduction of an ideal self-governing police system.
After all, if the current autonomous police system is a second-best effort due to consideration of the poor reality of local autonomy, the important legal task ahead is to strive for institutional settlement as a Korean-style autonomous police system, and the goal should be to realize the ideology of the autonomous police system under the current incomplete autonomous police system. The normative direction is, of course, to ensure the participation of residents, the essential ideology of local autonomy, and to meet the needs of residents' security as much as possible from a democratic point of view.
