자치경찰제의 논의의 검토와 향후 과제 (Review of Discussion on the Local Autonomous Police System and Future Tasks)

초록

자치경찰의 도입은 중앙집권화된 국가경찰 권한의 분산이라는 경찰권의 민주적 설계와 정치적 중립성 확보, 그리고 지방분권의 지방자치를 실현하는 방향으로 나아가야 한다. 또한 지역 불균형에따른 치안의 불균형 혹은 약화의 방지, 재정 투입을 최소화하여야 하며, 새로운 제도 도입에 따른치안 혼란을 최소화 하여야 한다.
향후 자치경찰의 도입에 있어서 다음의 사항을 고려할 필요가 있다. 경찰권의 민주적 설계, 자치경찰의 정치적 중립성을 확보, 자치경찰은 중앙정부 보다 각 지역의 다양한 치안수요에 부합하기 위한 방향으로 도입되어야 한다. 그리고 자기 책임성에 기한 전권한성을 부여받아야 한다는 점에서 지역에서의 치안의 주재자로서의 역할을 담당하여야 한다. 이 중에서 가장 중요한 것은 자치경찰의 부패를 막고, 지방 정치세력으로 부터의 독립을 가져갈 수 있는 시스템을 만들어야 하며, 보안행정경찰 이외에 사법경찰권을 집행하는 경우에 있어서 발생할 수 있는 인권침해의 요소를 방지할 수 있는 제도를 마련하여야 할 것이다. 자치경찰이 1차적 수사권(일정 범위의 범죄수사)을 가지고 있을경우, 인권 침해적 요소를 방지하기 위하여 사법경찰 업무와 일반보안경찰 업무를 명확히 구별하고사법경찰 업무에 대하여 이에 종사하지 아니하는 경찰이 개입 또는 관여할 수 없도록 절차와 인사제도를 마련하여야 할 것이다. 또한 수사 이전의 단계인 내사(추상적 사실에 바탕을 둔 주관적 혐의)가 부당하게 장기화 되지 않도록 하여야 할 것이며, 부당하게 내사가 종결되지 않도록 주의하고, 내사과정에서도 인권이 침해되지 않도록 하여야 할 것이다. 그리고 형사사법의 또 하나의 축인 피해자 보호 즉 경찰의 불기소 처분에 대하여 재판청구권의 실효적 확보방안이 마련되어야 할 것이다.
또한 자치경찰의 역량강화, 지역맞춤형 치안서비스 제공 등 지방자치원리의 충실면에서 광역지방자치단체 단위의 자치경찰을 운영하는 것이 바람직하다고 생각된다.

영어초록

The introduction of the local autonomous police system should move toward the realization of the democratic design and political neutrality of the police force through the decentralization of centralized national police authority and the local autonomy through decentralization. It should also prevent imbalance or weakening of the security in local areas due to regional imbalances, minimize fiscal input and security instability resulting from the introduction of the new system.
The following considerations need to be taken into account in the future introduction of the local autonomous police system. The democratic design of the police authority and the neutrality of the autonomous police should be secured, and the autonomous police should be introduced in a way to meet the various security needs of each region rather than the central government. In addition, in that they should be given full authority on the basis of self-responsibility, they should assume the role of the defender of security in the region.
The most important of these will be to establish a system to prevent corruption of local police officers, to take independence from local political forces, and to prevent the elements of human rights violations that may arise in cases of enforcement of judicial police authority in addition to security and administrative police. If the autonomous police have the primary right to investigate (crime investigations with a certain scope), procedures and personnel systems should be established to clearly distinguish between law enforcement and general security police operations and to prevent police who are not engaged in them from intervening or engaging in judicial police work in order to prevent human rights violations. It will also have to ensure that the internal investigation (subjective charges based on abstract facts) that are in the pre-investigation stage should not be unfairly prolonged, that the internal investigation should not be unfairly terminated, and that human rights should not be violated during the investigation. And another pillar of criminal justice, the protection of victims, i.e. the disposition of nonindictment, should be devised to effectively secure the right to appeal the case. Also, it is desirable to operate the local autonomous police units in the metropolitan cities in terms of the faithfulness of the local autonomy principles with strengthening the capacity of local police officers and providing local-specific security services.
