제10차 개정헌법에 대한 관견(管見) (A study on the 10th Amendment Constitution)

초록

30년만의 개헌이기에 많은 사람의 이해를 반영하려는 욕구가 넘치고 있어, 헌법개정의 험난한 과정이 예상된다. 국가사회 모든 영역에서 개헌요구사항이 봇물을 이룰 것이다. 헌법은 일반 법률과 달리 선택사항이 많기에 합의에 더 많은 노력이 요구되고, 합의를 도출하기가 그 만큼 어려울 수밖에 없다. 완벽한 개헌은 불가능하기에, 헌법개정은 부분개정 내지 전부 개정이 바람직하다. 헌법은 고쳐야 하는 것이지 바꾸는 것이 아니다. 현행 헌법의 경우 국가구조(통치구조)에 관한 보완이 강하게 요구된다. 헌법전문에서 6월 항쟁(6.10. 항쟁)을 추가하는 것을 생각할 수 있다. 정당해산의 제소권자를 정부에서 대통령으로 개정해야 한다. 생명권규정을 신설할 필요가 있으며, 제18조의 양심의 자유는 “사상 및 양심”의 자유로 한다. 또 청원을 대폭 개정할 필요가 있다. 국회를 양원제로 하고, 법률안에 대한 국민발안 및 국회의원에 대한 국민소환를 도입할 필요가 있다. 대통령의 임기를 4년으로 1차 중임하게 하며, 대통령 사고 시 권한대행의 방법과 대행자 결정을 규정하고, 보궐선거로 당선된 대통령의 임기를 정하고(부통령을 두지 않을 경우), 결선투표제를 도입하여야 한다. 동시에 대통령의 사면권을 제한하고, 대통령의 당적을 제한할 필요가 있다. 임기제 총리와 장관의 임기제, 국무위원과 장관의 겸임금지, 감사원의 소속을 국회로 이관, 고위공직자비리수사처를 신설하고, 국가인권위원회를 헌법기관화할 필요가 있다. 중앙선거관리위원회는 벌률기관화 해야 한다. 대법관 임명에 대법원장의 제청제도를 폐지하고, 헌법재판소 재판관 전원의 국회동의를 얻게 하며, 헌법재판소 재판관의 자격, 선출, 연임에 관한 규정을 개선해야 한다. 지방자치를 획기적으로 보완해야 한다. 자치권 존중과 조례를 이원화하는 하는 방법을 강구할 필요가 있다. 또한 헌법개정절차를 필수적 국민투표에서 국회의 가중된 다수로 개정할 수 있게 하고, 헌법개정 국민발안제도를 부활하여야 한다.

As the amendment is only 30 years old, the desire to reflect the understanding of many people is overflowing. A tough process is expected. In the meantime, the constitutional requirements of all the societies of society will become a burden. Unlike the general law, the Constitution has a lot of options, so more efforts are needed to reach an agreement, and it is hard to reach agreement.
I can think of adding the June conflict (6.10. Rebellion) in the constitutional text. The complainant of the dissolution of the party should be changed from the government to the president.
And it is necessary to establish the provision of the right to life, and the freedom of conscience of Article 18 shall be the freedom of thought and conscience. It is also necessary to revise the petition.
It is necessary to adopt the National Assembly as a bilateral system and introduce national proposals to the bill and national recall to the National Assembly members.
The term of office of the President shall be four years. The President can do twice. It shall specify the manner of agency and the decision of the agency in case of a presidential accident. The term of the President elected by-election shall be the remaining term of his predecessor. Also, the election system should be introduced. At the same time, it is necessary to restrict the president 's amnesty and limit the party' s party.
It is necessary to make the National Human Rights Commission a constitutional institution. The transfer of the members of the Board of Audit to the National Assembly. On the other hand, the Central Election Commission should be punitive.
In order to appoint the Supreme Court judge, it is necessary to abolish the Supreme Court's recommendation system, obtain the consent of all members of the Constitutional Court, and improve the provisions of the Constitutional Court's judge on qualification, election and succession.
Local autonomy should be supplemented dramatically. There is a need to find ways to dualize respect for autonomy and ordinances.
In addition, the constitutional amendment procedure should be revised from the essential referendum to a heavier majority of the National Assembly, and the constitutional amendment national initiative system should be revived.
