한국의 인터넷 실명제 유형과 발전방안 (A Type and a Developmental Plan for Internet Real Name System in Korea)

초록

본 연구는 온라인상에서의 실명 또는 본인 확인을 거치는 제도의 도입에도 불구하고 지속적인 사이버 폭력 사태가 빈발하고 있으며, 여전히 인터넷 실명제를 둘러싼 찬반양론이 첨예하게 대립하고 있는가에 대한 문제제기에서 출발한다. 그리하여 인터넷 상에서 개인과 집단의 온라인 활동의 유형과 법제화 과정에 대한 논의를 통해 최대다수의 합의에 기반하여 현행 인터넷 실명제를 발전시킬 수 있는 방안을 모색하고자 했다. 인터넷 실명제 법제는 인터넷 실명제의 제도적 취지와 국민의 기본권 사이에서 적절한 비교형량과 과잉입법이 자제되어야 하는 입법상의 원칙을 지키는 가운데, 보다 합리적이고 효과적인 규제방식을 고민하고 이에 대한 사회적 합의를 확산시켜 가려는 노력이 필요하다. 사회적인 문제가 발생했을 때 그에 대해 국가가 대처하는 것은 정부의 이념적 성격과는 무관한 것이라고 할 수 있다. 이명박 정부 하에서 논의되고 있는 것은 더욱 심화되고 있는 인터넷의 역기능과 사이버 폭력 문제의 해소를 위해 기존 법제의 틀 하에서 보완하는 측면의 성격이 강하다. 이런 관점에서 볼 때, 인터넷으로 인한 사회적 문제에 대한 적극적인 대처 방안으로서 인터넷 실명제를 위한 정책적 발전 방안과 입법 대응은 지속적으로 필요하다. 그것이 바로 ‘효과적인 국가’의 중요한 역할이라고 할 수 있으며, 건전한 인터넷 문화의 조성과 익명성의 폐해를 시정해 나가는 지름길이다.

영어초록

Internet real name system is fundamentally the theme of symbolizing a collision between ‘freedom of expression’ and ‘protection of reputation,’ which are important values of democratic society. Thus, the aim was to seek a plan available for developing the current internet real name system based on agreement of the largest majority through discussing about the type and the legislation process of online activity in individual and group on online. The internet real name system, which is being enforced in Korea, needs to be understood as a desperate counter measure for the internet culture peculiar to Korea, especially for the reply culture. Of course, it is not too much to say that there is a need of being legislated with a method of not infringing on basic rights such as freedom of expression, a right to know, and secrecy & freedom of privacy in this legislation and developmental process. Accordingly, as for the legislation of internet real name system, there is a need of striving to be worried about the more reasonable and effective regulation method and to proceed with expanding social agreement on this in the middle of keeping the principle in light of legislation, which needs to be controlled the excessive legislation in addition to the proper comparative penalty between the institutional purport and people’s basic rights. What the country copes with it when a social issue took place can be said to be unrelated to the government’s ideological characteristic. Considering this matter, the Cyber Defamation Law, which is being driven with entering the Lee Myeong-bak’s government, is difficult to be said to have appeared from the completely new idea. What is being discussed under the Lee Myeong-bak’s government has strong characteristic of complementing under the existing legislative frame in order to remove internet dysfunction and cyber violation issue, which are getting deepened. Seeing from this perspective, the policy-based developmental plan and the legislative counter measure for internet real name system is continuously needed as a positive coping plan for social issue caused by internet. It can be said to be just important role of ‘effective nation’ and is a short cut of proceeding with forming sound internet culture and modifying an evil influence of anonymity.
