선거구제 개편을 위한 헌법적 설계 (A Constitutional Design for Reorganization of Electoral Districts)

초록

한국에서 정치 발전을 위해 선거체계의 개선을 주장할 때 자주 언급되는 것 중의 하나가 선거구제 개편이다. 이러한 논의의 배경에는 현행 1석선거구제에 대한 강한 거부감이 있다.
선거구제 개편은 정치적 경쟁과 정치적 통제를 강화하기 위한 수단으로 그리고 한국 정치의 발전을 위한 발판으로 논의되어야 한다. 다석선거구는 선거의 비례성을 증진한다는 점에서 부분적이나마 비례대표선거제의 「기능적 등가물」이라 할 수 있다. 선거구제 개편은 한국에서 비례대표선거체계가 제대로 작동되지 못함에 따른 부득이한 대안이다.
다석선거구제 도입에서 가장 중요한 것은 선거구 규모와 선거구 획정이다. 바람직한 정당체계가 온건다당제라고 보기 때문에, 3석의 선거구 규모가 가장 바람직하다고 본다. 다만, 선거구 획정의 현실적 여건(인구의 크기, 행정단위, 도시·농촌 등의 지역적 특성 등)을 고려하여 예외적으로 1석, 2석 또는 4석선거구를 포함할 수 있다고 본다.
선거구제 개편과 관련하여 투표방식의 변경을 적극 고려할 필요가 있다. 현행 단기투표방식으로는 다석선거구제에서 낮은 득표수로도 당선될 수 있다. 그래서 선거결과에 대하여 민주적 정당성의 문제가 제기될 수 있다. 또한 선거권자의 선택 폭을 넓힘으로써 정치적 통제를 강화할 필요가 있다. 그런 점에서 제한연기투표방식을 제안하고자 한다.
선거구제 개편과 행정구역 개편은 밀접한 관련이 있으나, 그 시행에 있어서는 시간적 차이를 두고 논의하여야 할 것이다.
한편, 선거구 획정의 어려움 등을 이유로 선거구제 개편을 지연하려는 시도가 대두될 수 있다. 따라서 다석선거구제를 도입하더라도 그 본격적 실시 시기를 차차기 총선부터 하는 것을 생각할 수 있다.

영어초록

The reorganization of electoral districts is one of the things that are often mentioned when advocating improvements to the electoral system for political development in Korea. Behind this debate is a strong sense of rejection of the current one-seat constituencies.
Reorganization of electoral districts should be discussed as a stepping stone for the development of Korean politics, and as a means of strengthening political competition and political control. Multi-member districts are partly the "functional equivalent" of proportional representation electoral system in that they promote the proportionality of elections. The reorganization of electoral districts is an unavoidable alternative because the proportional representation electoral system has not functioned properly in Korea.
The most important thing in the introduction of the multi-member districts system are the district magnitude and the delimitation of electoral districts. Since the preferred political party system is a moderate multi-party system, the three-seat constituency size is considered the most preferable. However, one-seat, two-seat or four-seat constituencies may be exceptionally included, because of the difficulties of electoral boundary delimtation that must reflect many criteria such as population size, administrative boundary, regional characteristics such as urban and rural areas.
It is necessary to actively consider changing the voting system in relation to the reorganization of electoral districts. The current voting system allows candidates with a few votes to be elected. Therefore, democratic legitimacy for election results may be challenged. There is also a need to strengthen political control by increasing the range of electoral options. As an alternative the limited voting system may be preferred.
The reorganization of electoral districts and the reorganization of administrative districts are closely related, but their implementation should be discussed at different times.
Due to the difficulties of delimitation, attempts to delay the reorganization of districts can emerge. Therefore, even if multi-member constituencies are introduced, it is conceivable that full-fledged implementation of them will begin after the next general election.
