제3세대 인권인 국제연대권 (The Right to Solidarity in International Human Rights Law)

초록

21세기 권력의 주체는 국가외에도 기업과 비국가행위자의 출현으로 지난 세기와는 다른 양상의 인권침해와 환경, 기후문제가 발생하고 있다. 인류형제애와 관련되는 제3세대 인권으로 부르는 국제연대권에 대한 개념이 생성되고 있다.
국제연대권은 개발권, 자기 결정권, 소수자 권리, 건강한 환경에 대한 권리, 평화권과 인류공동유산의 소유권으로 발현되고 있다. 인권과 국제연대 독립전문관 절차를 통하여 국제연대권 선언안을 마련하였다. 선언안은 국제연대가 인권의 완전한 실현을 성취하는 것임을 확인하고, 국제연대권의 인정과 구체적인 이행방안을 제안하고 있다.
선언안은 기존의 국제인권조약상의 국가의무, 초영역적 국가의무, 비국가행위자의 역할과 의무를 강조하고 있다.
자유권 규약과 사회적 규약상의 권리가 이러한 과정을 거쳤듯이, 국제연대권은, 문화적으로 다양한 방식으로 국내적‧ 지역적으로 효과적으로 이행 될 수 있다. 국제연대 권은 국가는 자발적으로 만들어낸 법적 근거에 따라 직접 행동을 취함으로써 실현가능한 권리가 된다. 국가는 자국정책이 타국의 인권을 침해하지 않도록 보장하는 ‘초영역적 국가의무’를 가진다는 접근이 인권의 온전한 실현을 가능케 한다.
이념, 종교, 인종 등의 인권침해로 얼룩졌던 지난 세기의 갈등요소를 넘어서 기후와 환경문제 등이 인류를 위협하는 요소로부터 인류가족 전체의 삶을 보호하고 위하여, 국제연대를 원칙과 권리로 고려하는 새로운 패러다임의 전환이 필요하다. 개인의 생존권 보호의 전제로서 인류공존을 보장하는 법정책적 방안에 대한 고민을 시작할 때이다.

영어초록

The emergence of corporations and non-state actors in addition to the state in the 21st century has caused human rights violations, environmental and climate problems different from those of the last century. The concept of the right to international solidarity called the third generation human rights related to the human brotherhood is generating.
The right to international solidarity is manifested as the right to development, self-determination, minority rights, a healthy environment, the right to peace and the common heritage of mankind. The Independent Expert on human rights and international solidarity of special thematic procedures supervised by the UN Human Rights Council has been put in place to formulate the draft declaration on the right of peoples and individuals to international solidarity(the declaration) The Declaration confirms that international solidarity is the achievement of the full realization of human rights, and proposes the recognition of international solidarity rights and concrete implementation measures. The Declaration stresses state obligations under existing international human rights treaties, extraterritorial state obligations and non-state actors' roles and obligations The right to international solidarity can be effectively implemented nationally and regionally in a variety of culturally diverse ways. The right can be a viable right by taking a hands-on work directly based on legal basis which states enact voluntarily.
The approach that the state has a extraterritorial obligation to ensure that its policies do not infringe the human rights of people in other countries enables the full realization of human rights.
Beyond the conflicts of the last century, which have been plagued by human rights violations such as ideology, as religion and race, climate and environmental issues are threatening human beings, in order to protect human family lives as a whole, paradigm shift is necessary in which we consider international solidarity as a principle and a right. It is time to start concerning about the legal policy making to ensure the coexistence of human beings beyond the individual's right to life.
