교육헌법 개정 논의의 흐름과 쟁점 검토 : 헌법 제31조와 제22조의 개정안을 중심으로 (A Study on the Trends and Issues of Discussion on the Reform of Education Constitution: Centered on Amendment of Article 31 and 22 of the Constitution)

초록

2017년 겨울부터 정치권과 각계각층의 개헌 논의가 봇물처럼 터진바 있다. 교육계에서도 교육 관련 헌법 조항들, 즉 교육헌법의 개정 논의가 간헐적으로 제기되어 왔다. 대통령이 발의한 개정안이 국회에서 의사정족수를 충족하지 못함으로 인하여 폐기된 이후 잠시 주춤하고 있지만, 결국 국회는 개헌논의를 재개할 것으로 전망한다.
본 논문의 취지는 지금까지 몇 년 동안 그리고 최근 개헌 정국에서 제기된 헌법 31조와 22조를 중심으로 하는 교육헌법 개정 논의의 흐름을 파악하고 종합하여, 개정안 상호간에 접점을 보인 것은 이를 수용하여 교육계의 개헌안으로 확정하여 강력하게 제안하고, 쟁점이 되는 것들은 면밀한 검토를 통하여 버릴 것은 버리고 취할 것은 취하여 역시 개정안으로 채택하여 제안하는 것이다.
인터넷을 검색해본 결과 교육헌법 개헌 논의에 특히 적극적인 곳은 교직단체들과 관련 학술단체, 국회 헌법 개정 자문기구, 그리고 국가인권위원회와 정부이다. 각 기관 또는 단체들의 주장이 서로 달라서 전체적으로 어떤 흐름을 이루고 있는가 하는 점을 파악하기 위해 모든 제안들을 한 자리에 놓고 비교해보았다.
검토 결과 헌법 31조의 의무교육의 적용대상 및 무상 범위의 법률 유보, 교육의 자주성 등과 지방교육자치의 보장, 22조의 대학의 자치 보장 등에 관해 어느 정도 접점을 보이고 있지만 학습권의 신설 등 다른 많은 부분들에서 접점보다 쟁점들이 제기되고 있다.
향후 교육헌법 개정 논의가 재개되면 시대 흐름에 부합하는 합당한 개헌안을 도출할 수 있도록, 이미 접점에 이른 내용들은 물론 다투어지고 있는 내용들도 타당성을 면밀히 검토하여 개헌안에 적극 반영하여야 할 것이다.

영어초록

This paper covers the flows and tasks of discussing the amendment of the Education Constitution. In particular, the review revolves around the revision of Article 31 and 22 of the Constitution.
In the last winter and spring, diverse discussions on constitutional amendment, including political circles, took place actively. There has been also sporadic discussions about the revision of the education constitution in the education community. Discussions on constitutional amendment have been suspended for a while since the presidential proposal was scrapped in the National Assembly. In the end, however, we expects the National Assembly to resume discussions on constitutional amendment. The new speaker recently confirmed this.
This paper refers to the flow of discussions on revising the Education Constitution, which has been going on since the ninth revision in 1987. It sums up how many consensual amendments are in the way. Also it considers what are still remaining issues at this point. It looks at how to resolve the issues and come up with a proposition that we can all agree on.
First, it has only been in the last few months that the idea of constitutional amendment in the education sector has taken effect. According to an internet search, the most active forces for discussing constitutional amendment are teachers’ organizations, academic organizations involved, advisory bodies for revision of the Constitution of the National Assembly, and the government.
Second, after reviewing all of the amendments to the education constitution, not many of them have reached an agreement. Most of the amendments were different.
Third, as a result of comprehensive review in this paper, the eight contents are included for amendment of education constitution conclusionally : the subject of the basic right of the education constitution, right to learning, the scope of compulsory education, the content and scope of free education, the autonomy and professionalism of education and political neutrality, the basis for establishment of the National Education Board for education autonomy, adoption as a constitutional measure of the first article of the Private School Law, university autonomy, etc.
