초록

수사권조정에 따라 경찰은 1차적 본래적 수사기관으로, 검찰은 제한된 수사권을 가진 2차적 보완적 수사기관으로 자리매김하였다. 이제 검찰은 수사의 주재자라는 지위를 내려놓고 수사ㆍ기소에 있어 경찰과 상호 협력하는 입장에 놓이게 되었다. 검찰청법은 검사의 직접수사개시권을 6대 중요범죄, 경찰관 범죄, 송치된 범죄와 직접 관련성 있는 범죄로 한정하였고, 그 구체적인 내용은 대통령령이 정하고 있다. 수사범위의 제한에도 불구하고 검사의 직접수사개시권은 여전히 넓게 인정되고 있어 검찰개혁의 효과가 반감되었다는 비판이 있고, 게다가 대통령령은 법률이 위임한 한계를 벗어나는 내용을 규정하여 검사의 수사범위를 확대한 문제점이 발견되고 있다. 향후 입법적 개선이 요구된다. 내년부터 시작되는 수사권조정이 안착될 수 있기를 기대한다. 검찰은 더 이상 강력한 수사기관이 아닌 형사절차에서 객관성과 공정성을 높이는 기소기관으로 자리 잡아야 한다. 반면 경찰은 수사의 전문성과 공정성을 갖출수 있는 제도적 기반을 마련하고 내실도 다져 1차적 수사기관의 위상에 맞는 역할을 다할 수 있어야 한다. 정부와 국회는 수사와 기소를 완전히 분리하기 위한 검찰개혁과 형사사법제도의 개혁을 지속적으로 추진해 나가야 한다.

영어초록

Following the adjustment of investigative power, the police have established themselves as the primary original investigative agency, and the prosecution has become the secondary complementary agency with limited investigative power. Now, the prosecution is expected to put down its status as a supervisor of the investigation and cooperate with the police in the investigation and indictment. The Public Prosecutors’ Office Act limits prosecutors’ right to initiate direct investigations to crimes directly related to the six major crimes, police officers’ crimes and the crimes sent to them, and the details of which are prescribed by the Presidential Decree. Despite restrictions on the scope of the investigation, critics say that the prosecution's right to launch direct investigations is still widely recognized, which has halved the effectiveness of the prosecution’s reform. On top of that, the presidential decree has expanded the scope of the prosecution’s investigation by stipulating details beyond the limits mandated by the law. Future legislative improvements are being called for. It is hoped that the adjustment of investigative power, which begins next year, will be settled. The prosecution should no longer establish itself as a powerful investigative agency, but as a prosecuting body that increases objectivity and fairness in criminal procedures. On the other hand, the police should play a role that suits the status of the primary investigative agency by laying the foundation for the expertise and fairness of the investigation. The government and the National Assembly should continue to push for reform of the prosecution and the criminal justice system to completely separate investigations and prosecutions.
