SPS 지역화와 국제기준과의 조화 – SPS 제3조와 제6조와의 적용관계- (Harmonization of International Standards in the context of ‘SPS Regionalisation’)

초록

SPS 지역화 분쟁사건에서 SPS 협정 제6조 뿐 아니라 SPS 협정 제3.1조의 위반 또한문제되어왔다. 본 고에서는 ‘SPS 지역화’와 관련한 국제기준(국제표준, 지침 및 권고)의발전과 SPS 지역화를 둘러싼 분쟁사건에서의 SPS 협정 제3조의 적용 및 그에 대한 평가와함께 바람직한 제3조의 적용에 대해 고찰해보았다.
SPS 지역화와 관련한 국제기준으로는 OIE에서의 육상동물위생규약 및 수산동물위생규약이 있으며, IPPC에서의 발간된 여러 국제 표준이 있다. 이러한 국제기준은 EU가 추진하는 최근의 FTA에서 지역화와 관련하여 국제기준에서의 구획 원칙과 IPPC의 해충안전생산소 원칙을 인정할 것 등의 명시적 규정을 통해 직접적으로 수용되고 있는 추세로 앞으로 더욱 중요성이 커질 것으로 보인다.
이렇게 심화발전되고 있는 SPS 지역화와 관련된 국제기준은 SPS 지역화 사건의 제3조의 적용과 관련하여 문제되고 있다. SPS 지역화 관련 특정 국제기준과 대치 또는 모순될경우 국제기준에 기초한 것이 아니라는 ‘흑 아니면 백’식의 접근을 통해, 사실상 국제기구에서 나오는 국제표준, 지침, 권고보다 국내적으로 높은 기준을 설정한 경우 제3.1조의위반으로 판시되는 결론으로 이끌고 있다. 이러한 제3조의 적용의 문제점과 바람직한 해석방향에 대해 고찰해보고 우리나라의 대응방안에 대해서도 짧게 고찰해본다.

영어초록

Violations of SPS Agreement Article 3.1 as well as Article 6 have also been problematic in the ‘SPS Regionalisation’ Dispute. This article explores the development of the international standards, guidelines or recommendations related to 'SPS Regionalisation' and the interpretation and application of Section 3 of the SPS Agreement in disputes over ‘SPS Regionalisation’, along with its assessment.
International standards, guidelines or recommendations for ‘SPS Regionalisation’ include the OIE Terrestrial Animal Health Code and the OIE Aquatic Animal Health Code, and several international standards published by the IPPC. These international standards are expected to gain more importantance in the future as regulation such as recognition of the principle of compartmentalisation of the OIE and pest-free production sites of the IPPC are being accepted explicitly in recent EU FTAs.
As international standards, guidelines or recommendations relating to ‘SPS Regionalisation’ are developed, the application of Article 3 in the ‘SPS Regionalisation’ dispute has become a serious issue. The WTO dispute settlement body held that a Member's measure could not contradict the international standards, guidelines or recommendations, and nevertheless be considered based on it within the meaning of Art. 3.1. As the particular SPS measures contradicted certain recommendations of the OIE Terrestrial Animal Health Code, the relevant international standard, the Panel found that the measures were inconsistent with Art. 3.1. Since the OIE had come up with the detailed recommendations for compartments in various animal disease, this likely leads to a conclusion of a violation of Article 3.1, if Members may try to achieve a higher level of health protection than that reflected in international standards, guidelines or recommendations relating to ‘SPS Regionalisation’. This article explores the problems of this interpretation and suggests a desirable interpretation and application of Article 3 in ‘SPS Regionalisation’ Disputes.
