추첨형 대의제와 헌법 (Representation by Sortition in Constitutionalism)

초록

무작위 추첨과 숙의절차로 구성된 공론조사가 점차 활성화됨에 따라 추첨에 의한 결정이, 이성주의, 사회적 정의, 능력주의와 같은 현대 입헌주의의 토대가 되는 헌법적 가치들에 위배되는 것은 아닌지 의문이 제기되고 있다. 운에 의한 재화의 배분은 필요, 능력, 자격, 지불능력, 선착순과 같은 재화 배분 방식과 아주 다른 배분 방식이다. 추첨에 의한 공직 배분의 일종인 추첨형 대의제는 특히 선거형 대의제를 기반으로 하는 현대 헌법적 가치들에 반한다는 혐의를 받아왔다.
추첨으로 재화를 배분하는 것은 이성적 활동에 대한 포기처럼 보이지만 이성적 활동으로 더 이상 답을 구할 수 없을 때, 객관적이고 편견이 개입할 수 없다는 점에서 추첨이 가장 합리적인 방법일 수 있다. 무작위 추첨의 불편부당성으로 인해 추첨에 의한 공직 배분은 현대 헌법적 가치 특히 이성주의와 배분적 정의와 양립가능하다. 추첨형 대의제에는 투표와 같은 구체적인 위임행위가 없다는 이유로 헌법의 동의 및 위임 원리에 부합하지 않는다고 논박되기도 하지만, 추첨형 대의제는 애초부터 대표자의 의사가 유권자 전체의 의사와 확률적으로 일치하도록 고안된 것이기 때문에 이는 성립될 수 없는 주장이다.
추첨형 대의제를 포함하여 추첨에 의한 공직 배분에 대한 가장 유력한 이의제기는 현대 헌법에 내재된 가치로 간주되는 능력주의로부터 나온다. 그러나 사회적 재화와 권력은 물려받는 것이 아니라 자신의 재능과 노력에 따라 주어져야 한다는 능력주의는, 점차 심화되는 불평등으로 말미암아 계층 이동성이 축소됨으로써 나타나는 이른바 능력주의의 철칙으로 인해 사이비 능력주의로 귀결된다. 따라서 현대 헌법이 지향하는 능력주의는 사회국가 원리에 정향된 능력주의이고, 실질적 평등을 추구하는 추첨형 대의제는 사이비 능력주의를 배제한다는 의미에서 현대 헌법 원리에 부합한다.

영어초록

With the gradual activation of public opinion polls consisting of random selection and deliberative procedure, strong doubts have been raised about whether sortition would violate the constitutional principles and values based on the modern constitutionalism such as rationalism, social justice and meritocracy, etc.
Assignment on the basis of luck is not equivalent to assignment on the basis of need, merit, desert, wealth, or patience but a radically different alternative to any of these assignment procedures. Representation by sortition, a kind of assignment of public offices by lot, has been suspected of infringing on modern constitutional values built on electoral representation.
Powerful as it is, rationalism generates reliable answers only where the relevant facts, well defined and accepted, are at hand. Unfortunately when reason has done what it can, chance can complete the job because it is objective and has no bias. That impartiality can make a sortition system be compatible with the modern constitutional values, especially rationalism and allocative justice. Futhermore, it is not reasonable to argue that sortition does not meet the principle of consent and mandate because there is no specific act of mandate, such as voting. Because it is designed to probabilistically guarantee that the opinions of representatives are those of the entire electorate.
In fact, the strongest objection to allocation of public offices by lot comes from one of the implicit values of modern constitutionalism: meritocracy. However, the meritocracy in which social goods are vested in an individual on the basis of talent, effort, and achievement, rather than factors such as heredity or wealth inevitably leads to pseudo-meritocracy because of the so-called iron law of meritocracy, stating that eventually the inequality produced by a meritocratic system will grow large enough to subvert the mechanisms of mobility. Thus, the meritocracy oriented by the modern constitution is interpreted as the meritocracy modified through the principle of social state, and the representation by sortition seeking substantive equality conforms to the modern constitutionalism in the sense that it excludes pseudo-meritocracy.
