제주자치경찰제의 실태분석과박근혜정부의 자치경찰제 도입 방향 (An analysis on the system of Jeju municipal police and the Park administration's direction on municipal police system)

초록

이 논문에서는 제주자치경찰제의 현황과 문제점을 분석하고 동시에 박근혜 정부가 기초자치단체를 중심으로 도입 추진 중인 전국 자치경찰제의 방향을 살펴보았다. 본 연구에서 필자는 오래전부터 국가경찰과 학계 및 시민단체 간에 자치경찰제의 도입시 수사권 부여가 필수적이라는 주장 등 끝없는 논쟁이 있었으나 이제는 이를 중단하고 본래 지방자치단체의 1차적 치안업무라고 볼 수 있는 등·하교시간대의 학교폭력예방, 담배꽁초의 길거리 무단투기 단속, 불법광고물 단속, 일반쓰레기 무단투기 단속, 불법 주·정차 단속, 제주관광지에서 관광경찰의 단속업무 및 17개 분야의 60개 법률에 속한 특별사법경찰업무들 만을 집중적으로 다루는데 한정된 자치경찰제 모델의 도입이 바람직하다고 제언하였다. 실제로 프랑스, 스페인, 이태리의 자치경찰제는 이러한 방식을 통해 잘 운영되고 있다. 특히 본 논문에서는 우리나라 자치경찰제가 영국, 미국, 일본에서와 같은 형태의 지방경찰제 모델로 재정립 하는 것이 아니라면 차라리 현재 국가경찰제를 그대로 두자는 주장이다. 그리고 전국 기초자치단체에서는 위에서 지적한대로 본래 고유의 치안업무만을 집중 발굴하여 자치경찰관들로 하여금 수행하도록 하는 고유의 자치경찰제 모델을 도입·시행하는 방향이 좋겠다고 제언했다.

영어초록

Discussions on municipal police system hit their stride as the reconciliation mood between South and North Korea has come to a heed since the Roh administration(Feb 2003 to Feb 2008) and the atmosphere for democratization has revived. Jumping on this bandwagon, municipal police system has started in Jeju Island in July 2006 for the first time in Korea and has become well established for 8 years and 10 months now. The Jeju municipal police system can be a good example for a new municipal police system that is expected to be enforced in the Park's administration.
This paper analyzed the current status and problems of the Jeju municipal police system and examined the direction of the Park administration's municipal police system that is being push ahead with. The author in this paper suggested that it is time to stop endless disputes over an investigation right of municipal police among the national police, academic circles, and civic groups, and is advisable to introduce a limited municipal police model focusing on the duties of special judicial police belong to 60 regulations of 17 categories and primary duties for public order such as prevention on school violence, crackdown on illegal throwing away of cigarette butt, crackdown on illegal advertisement, crackdown on illegal throwing away of rubbish, crackdown on illegal parking, and duties of tourist police in Jeju's tourist attraction. In fact, municipal police systems in France, Spain, and Italy have well operated in this range. In particular, this paper argues that it would be better to maintain the current national police system if the municipal police system is not reestablished like the cases of the U.K., the United States, or Japan. It also suggested that it would be better for local self-governments from all over the country to introduce and enforce local municipal police system focusing on inherent duties of maintaining public order as is mentioned above.
