형법 제31조 제2항 및 제3항에 대한 연혁적 고찰 (An Historical Examination of Article 31 Clauses 2 and 3 of the Korean Criminal Act)

초록

형법 제31조 제2항 및 제3항은 교사의 미수를 규정하고 있다. 이에 의하면 교사자 또는 피교사자는 예비 또는 음모죄에 준하여 처벌된다. 공범이 정범과 독립하여 성립한다는 견해에 의하면, 이 경우는 미수범으로 처벌되어야 한다. 반면 공범이 정범에 종속하여 성립한다는 견해에 의하면, 이 경우는 원칙적으로 처벌할 수 없다. 따라서 우리 형법의 규정방식은 공범이 정범에 종속하여 성립하는가, 아니면 독립하여 성립하는가에 대한 대립을, 절충한 것이라고 할 수 있다. 이 글은, 그러한 절충방식이 어디에서 왔는가를 연혁적 관점에서 고찰하고자 하였다.
일본의 개정형법가안에서 교사의 미수는 형법총칙에 규정되지 못하였다. 다만 형법각칙에서 개별적이고 독립된 범죄형태로 규정되었다. 한편 만주(滿洲)형법에서는 교사의 미수를 형법총칙에 규정해 두고 있는데, 예비죄에 준하는 것으로 하였다. 우리 형법에 큰 영향을 끼친 이 두 가지 입법태도를 분석해 보면, 우리 형법은 공범이 정범에 종속하여 성립한다는 견해를 따른 것이라고 생각된다. 이것은 입법자의 의사와 함께, 우리 형법과 개정형법가안의 차이에서 발견할 수 있다. 우리 형법은 개별적이고 독립된 교사의 미수 범죄들을 규정하면서도, 개정형법가안과 달리 그 범죄의 목록을 크게 삭제하였으며, 법정형도 예비와 음모죄에 한정하여 두고 있기 때문이다.

영어초록

Article 31 Clauses 2 and 3 of the Korean Criminal Act present stipulations on attempts to instigate crimes. According to these clauses, the punishments for conspiracies or preparatory actions for crimes are applied to instigators and the instigated. According to the opinion that accomplices are realized independently from principals, such cases must be punished as attempted criminals. On the contrary, according to the opinion that accomplices are realized in subordination to principals, such cases in principle cannot be punished. Consequently, the method of stipulation in the Korean Criminal Act can be seen as a compromise between the two opposing opinions regarding whether accomplices are realized in subordination to or independently from principals. This paper seeks to examine the origins of this method of compromise from a historical perspective.
The Provisional Revision Draft of Japanese Penal Code of 1940 failed to present stipulations on attempts to instigate crimes in its General Provisions. However, the Particular Provisions of the same draft stipulated such attempts as individual and independent forms of crimes. On the other hand, the Penal Code of Manchukuo presented stipulations on attempts to instigate crimes in its General Provisions, seeing such attempts as tantamount to crimes in the preparatory stage of offence. Upon analysis of these two legislative attitudes, which have affected the Korean Criminal Act considerably, the Korean Criminal Act seems to follow the opinion that accomplices are realized in subordination to principals. This can be confirmed, first, from the legislators’ intentions. Second, it can be found in the differences between the Korean Criminal Act and the draft of Japanese Penal Code. The Korean Criminal Act presents stipulations on individual and independent “attempted instigation” crimes. However, unlike the draft of the Japanese Penal Code, the list of these crimes has been deleted to a considerable extent, and statutory punishments likewise are limited to conspiracies or preparatory actions for crimes.
