중국 사전연명의료의향서의 법적 규제의 난점과 입법 개선 방안 (The Dilemma and Legislative Improvement of the Legal Regulation of Advance Living Will in China)

초록

사전연명의료의향서(Living Will)란 개인이 의식이 명료한 상태에서, 향후 의사결정 능력을 상실할 수 있는 의료 상황에 대비하여 미리 작성하는 의료 선택선언이다. 이 제도는 많은 국가에서 비교적 잘 갖추어진 법률 체계를 통해 운영되고 있으며, 개인이 생애 말기에 의료 자율권을 보장받을 수 있도록 한다. 그러나 중국에서는 사전연명의료의향서에 대한 법적 규제가 아직 초기 발전단계에 있으며, 현행 법률 체계는 해당 제도를 전면적으로 포괄하지 못하고 있다. 현재로서는 선전 경제특구의《의료조례》를 통해 일부 지역에서만 제한적으로 인정되고 있다. 본 논문은 먼저 사전연명의료의향서의 법적 근거 및 중국내 현황을 분석하고, 이 제도가 입법 차원에서 미비하며, 대중의 인식 수준 또한 낮다는 문제점을 지적한다. 다음으로, 중국 법체계 내에서 사전연명의료의향서가 적용되는 데에 있어 직면한 현실적 어려움을 고찰하며, 그 주요 내용으로는 적용 주체의 범위 불명확, 적용 상황의 불확실성, 등록 제도의 부재 등을포함한다. 특히 실제 의료 현장에서는, 의료기관이 윤리적 딜레마에 직면하거나, 환자 가족의 의견이 엇갈리는 상황, 그리고 제도적 법률 보호 장치가 미비하다는 등의 이유로 사전연명의료의향서의 이행이 원활히 이루어지지 않는 문제가 존재한다. 이러한 문제를 해결하기 위해, 본 논문은 사전연명의료의향서관련 법제의 개선 방안을 다음과 같이 제안한다. (1) 사전연명의료의향서의 적용 범위를 확대하여, 보다 다양한 의료 결정 상황을 포괄할 수 있도록 한다. (2) 심사 체계를 강화하여, 사전연명의료의향서의 합법성과 집행 가능성을 확보한다. (3) 통일된 등록 제도를 구축하여, 환자의 의료 선택이 실제로 이행될수 있도록 법적·제도적 기반을 마련한다. 또한, 한국의《연명의료결정법》등해외 사례를 참고하여, 의료기관 윤리위원회 제도를 도입함으로써 의료 결정의투명성과 공정성을 제고할 필요가 있다. 종합적으로 볼 때, 중국의 사전연명의료의향서 제도는 아직 탐색 단계에 머물러 있지만, 법률 연구의 심화와 사회적수요의 증가에 따라 향후 발전 가능성이 매우 크다. 법제 정비, 사회적 인식제고, 그리고 의료 시스템의 제도적 개혁을 통해, 사전연명의료의향서는 환자의 생명 존엄성과 자율권을 보장하는 중요한 법적 수단으로 자리잡을 수 있을것이며, 이는 중국의 의료 윤리 및 법률 체계 발전에도 긍정적인 촉진 역할을할 것이다.

영어초록

A Living Will is a statement of medical choices made in advance by an individual, while conscious, in response to a future medical condition in which he or she may lose decision-making capacity. In many countries, this system has formed a relatively comprehensive legal system to protect the autonomy of individuals at the end of life. However, in China, the legal regulation of advance directives is still in the initial stage of development, and the current legal framework does not yet fully cover the system, which is only partially recognised in the Medical Regulations of the Shenzhen Special Economic Zone. This paper first analyses the legal basis of living wills and its current situation in China, pointing out the lack of legislation and insufficient public awareness of the system. Secondly, it discusses the difficulties in the application of living wills in the Chinese legal system, including the definition of the scope of subjects, the uncertainty of the applicable circumstances and the lack of a registration system. Especially in practice, the implementation of living wills is often faced with ethical dilemmas of medical institutions, disagreements of patients’ families, and insufficient legal protection mechanisms. To address these issues, this paper proposes recommendations to improve the legal system of advance directives, including: (1) expanding the scope of application of advance directives to cover more medical decision-making scenarios; (2) strengthening the review mechanism of advance directives to ensure their legality and enforceability; and (3) setting up a unified registration system for advance directives toensure that the patient’s medical choices can be effectively implemented. In addition, drawing on foreign experience, such as South Korea’s Life-Sustaining Treatment Decision Act, a system of ethics committees for healthcare organisations has been introduced to promote transparency and fairness in medical decision-making. On balance, although China’s living will system is still in the exploratory stage, it holds great promise for development as legal research deepens and social demand grows. Through legal improvement, social publicity, and supporting reforms of the healthcare system, living advance directives are expected to become an important legal tool for safeguarding the dignity and autonomy of patients’ lives, thus promoting the further development of China’s medical ethics and legal system.
