문화재 주변 현상변경허가 신청안 분석 및 문제점에 관한 연구- 현상변경허용기준 수립 문화재를 중심으로 - (A Study on Analysis and Problems of Deliberation to Change the Present Condition Around Cultural Properties - Focusing on the Cultural Properties of Standard Establishment for Change the Present Condi)

초록

본 연구는 문화재 인근 주민의 민원을 최소화하고 현상변경허가 심의에 있어 의사결정의 일관성 유지를 위하여 현상변경허용기준이 수립되어 있는 경기도지정문화재 주변 현상변경허가 신청안을 중심으로 그 심의결과에 대한 경향과 문제점을 분석하였으며, 그 연구의 결과는 다음과 같다.
첫째, 82건의 신청안 중 문화재 유형은 경기도지정기념물과 유형문화재가 각 56%와 50%로 대부분을 차지했으며, 신청인은 개인이 84%, 신청용도는 신축이 94%, 신청시설은 주택이 40%로 가장 많았다. 가결 및 재심의 결과는 대상 문화재의 유형이 경기도지정기념물이 가장 많은 것에 비해, 부결 결과는 유형문화재가 가장 많이 신청되었다.
둘째, 심의결과는 가결이 48.7%로 가장 많았고, 부결 36.5%, 재심 14.6%의 순이었다. 가결 결정의 주요 사유는 문화재주변 경관 영향 미미였으며, 신청부지 주변의 기 건축물 존재 여부가 가결 결정에 있어 많은 영향을 미쳤다. 부결 결정의 주된 사유는 과도한 성․절토로 인한 문화재 주변경관 저해였으며, 가결 결정에 비해 신청건축물의 규모가 큰 것이 특징이다. 재심의 결정의 주요 사유는 현지조사 후 재심의 의결이 가장 많았다.
셋째, 1차 심의까지만 상정된 경우가 전체 82건 중 47.5%로 절반에 가까우며, 그에 따른 결과는 가결이 많았고, 동일안건의 상정횟수가 많아질수록 부결 및 재심의 결정이 많았다.
넷째, 신청구역은 현상보전지역과 역사문화환경보전지역에 신청한 경우가 각 33.7%와 20.2%로 가장 많았고, 부결 및 재심의에 비해 가결결정의 경우 다양한 구역에 고르게 신청을 하였다. 현상보전지역에 신청한 경우 가결결정이 많았고, 경기도문화재위원회 심의구역에 신청한 경우 부결결정이 가장 많았으며, 재심의 결정의 경우 두 구역이 비슷하였다.
다섯째, 부결안의 재신청시 가결의 경우는 건축 규모의 축소가, 가결안의 재신청시 부결의 경우는 건축면적 의 증가가 결과결정에 있어 많은 영향을 미치는 것으로 나타났다.
