헌법개정논의에 대한 재검토 (Rethinking the Discussion on Constitutional Revision - Focused on Four-Year, Two-Term Presidential System and Decentralized Government System -)

초록

현행 헌법이 1987년 채택되어 30년 이상의 운용과정을 거치면서 개헌논의는 20년 전부터 정치권에서 시작되었으며, 최근에는 많은 국민들이 개헌문제에 대해 관심을 보이고 있다. 한국의 정치사회에서 현행 헌법의 개정논의는 초기에는 정부형태 분야에 한정하여 정치인들이 선거과정을 배경으로 정략적인 이유로 제기된 것이었으나, 2009년부터는 국회를 중심으로 헌법개정연구를 위한 자문위원회 활동이 전개되면서 개헌논의는 공론화되기 시작하였다. 그리하여 현 시점에서의 개헌논의의 성과는 국회의 헌법개정에 관한 2009년과 2014년의 자문위원회 보고서를 비롯하여 학계와 시민단체 등에 의한 헌법 전반에 걸친 문제점 분석과 헌법개정의 방향을 제시하는 연구결과보고서 등이 상당한 수준으로 축적되어 있다는 점에서 의미가 크다.
2016년 이후 한국의 급격한 정치상황의 변화와 박근혜 대통령의 탄핵사건을 계기로 헌법개정의 실현가능성은 그 어느 때보다도 높다고 할 수 있으며, 여론조사에서도 개헌에 대한 국민 다수의 적극적 의사가 나타나고 있다. 2017년 5월 문재인 정부가 출범하면서 2018년 6월 지방선거와 동시에 개헌 국민투표를 실시하겠다고 개헌일정을 밝혔으나 여야간의 합의가 이루어지지 않고 있어 개헌시기는 지연될 가능성이 크다. 그러나 개헌에 관한 국민의 공감대가 형성된 이상 개헌을 계속 늦출 수 는 없으며, 개헌의 대상에 있어서는 전면적 개헌은 쉽지 않으므로 정부형태를 중심으로 하면서 국민적 합의가 이루어지는 일부 대상으로 한정하는 부분적 개헌이 이루어져야 할 것이다.
본고에서 필자는 개헌논의의 핵심 쟁점인 정부형태에 관하여 지금까지의 개헌논의의 전개과정과 최근 2018년 1월 공개된 국회 개헌특별위원회 자문위원회 보고서를 분석하면서 정부형태의 개헌방향에 관한 필자의 견해를 다시 한번 정리해서 밝히도록 한다. 필자는 그동안 개헌문제에 대해 발표한 몇 편의 논문을 통해 이원정부제 개헌에 대한 신중론의 입장과 대통령 4년중임제 개헌을 일관되게 주장해 왔으며 지금도 그 소신에는 변함이 없다. 다만 2016년 이후의 정치적 상황의 급격한 변화와 대통령 탄핵사태 속에서 국민의 개헌필요성과 분권형 정부형태에 대한 관심이 확대되고 있는 시대적 변화를 직시하면서, 필자는 견해를 일부 수정하여 대통령제의 근간을 유지하는 개혁방안을 부분적으로 보완하여 제시함과 아울러 국민적 관심이 높아지고 있는 새로운 분권형 정부제의 도입가능성과 그 성공조건에 대해서도 검토한다.

영어초록

As the current Constitution has operated for more than 30 years since its adoption in 1987, politicians have continued to discuss the revision of constitution for 20 years and recently many people show interest in the revision issue. Although early discussion has raised for political reasons with a background of election processes and has been limited to a form of government, the discussion on consitutional revision has publicized as an advisory committee led by the National Assembly began to act from 2009. Therefore, the discussion on the constitutional revisiont by now is meaningful in that it has yielded a significant amount of outputs including reports by the advisory committee in 2009 and 2014 and research results by academia and civil organizations analyzing the overall problems of the constitution and proposing the direction of the revision.
Taking the rapid changes in political situations in Korea and the impeachment of the former president Park Geun-hye in 2016 as an opportunity, the realizability of the constitutional revision is higher than ever, and the majority of people actively show positive opinions on the revision, according to polls. Although the Moon Jae-in Administration, inaugurated in May, 2017, has announced that the plebiscite on the revision will be held at the same time as the local election in June, 2018, the constitutional revision is likely to be delayed due to the disagreement between the ruling party and the opposition parties. However, the constitutional revision cannot be delayed anymore because the nationwide sympathy on the revision has already formed. For the subjects of revision, the possibility of overall revision may be low, and thus the partial revision that limits subjects to parts with nationwide sympathy may be desirable.
In this paper, focusing on the form of government that is the key issue of the discussion, the author analyzes the progress of discussion on the constitutional revision until now and the report released by the special advisory committee of National Assembly and restates own views on the direction of revising the form of government. Through the publication of several papers on the revision issue, the author has continued to express prudential opinions on the dual executive system and support the four-year, two-term presidential system, and the opinion has still not changed. However, observing the change of times in which people’s interest in the need of constitutional revision and the decentralized form of government induced by the rapid change in political situations and the impeachment of the former president since 2016, the author partially modifies the opinions, thereby proposing a reformation plan that maintains the foundation of the presidential system and reviewing the possibility of introducing the new decentralized government system with increasing national attention and its successful conditions.
