대통령직 인수제도의 재검토 (On Presidential Transition in Korea)

초록

민주화와 함께 정권교체는 새삼스런 일이 아니게 되었다. 다만 정권의 교체기에 수반하는 국정의 공백과 혼란을 최소화하는 방안이 중요하게 되었고, 이를 위하여 각종의 방안이 고안되었다. 대통령직 인수위원회 제도가 대표적인 예이며, 새 당선자의 국정 5년에 대한 기본적인 설계가 이 시기에 이루어지기 때문에 언론의 집중조명을 받는다. 그런데 그간 인수위원회의 활동에 대해서 반드시 긍정적인 시각만이 있었던 것은 아닌 듯하다. 이 글에서는 대통령직 인수위원회를 중심으로 정권교체 제도의 문제점을 공법적인 시각에서 살펴보고자 한다.
현행법상 인수위원회의 업무는 다음의 네 가지로 나누어진다. 정부의 조직․기능 및 예산현황의 파악, 새 정부의 정책기조를 설정하기 위한 준비, 대통령의 취임행사 등 관련 업무의 준비, 그 밖에 대통령직의 인수에 필요한 사항등이 포함된다. 그런데 실제 인수위원회의 활동 내용은 대통령당선자의 경험과 대통령직 수행의지 그리고 전임자와의 정치적 관계에 따라서 다양하게 나타난다. 김영삼 정부는 문민정부를 강조하여 민주화에 초점을 맞추었으며, 김대중 정부는 경제위기에 따른 비상정부적인 성격을 가졌는데 인수위원회의 구성과 활동에서 이러한 경향이 드러나고 있다. 노무현 정부는 참여정부를 기치로 내걸고 다양한 계층의 참여를 촉진한 바 있다. 현 정부는 인수위를 통하여 대규모의 행정조직 개편을 통한 전 정부와의 단절을 도모하였다.
5년 단임의 대통령제에 의하여 대통령직 인수는 정기적인 중요한 국가적인 행사가 되었다. 그간의 경험을 바탕으로 대통령직 인수법이 제정되어 있다. 성공적인 대통령직 수행을 위한 기초를 놓는 인수위원회의 활동은 매우 중요하다고 할 것이다. 이제까지 인수위의 활동을 볼 때 날이 갈수록 점점 체계적이고 의욕적인 인수활동을 해 왔다고 평가할 수 있다. 그러나 일부의 활동은 과욕에 의하여 졸속적인 처리 내용을 보였다.
인수는 일방적인 과정이 아니라 전임 정부와 새 정부가 원만한 국정의 계승과 발전을 위하여 서로 협력하는 과정이 되어야 한다. 이를 위하여 전임 정부도 인수에 협력하기 위한 기구를 조직하여야 하며, 인수인계의 방법과 절차에 관한 제도 정비도 필요할 것이다. 그간의 인수위원회의 운영경험과 미국등 외국의 사례를 분석하여 이글에서는 인수위원회 제도의 바람직한 제도개선 및 운영방법에 대한 검토를 하였다. 제도화의 방법으로 이 글에서는 인수위의 대화 파트너로서 전임 정부의 인계위원회의 구성, 인수를 위한 절차조항의 신설 그리고 인수형식으로서의 인수협약 제도를 제안하였다.

영어초록

With democratization, a change of regime often follows. At the same time, the means of minimizing the disruption and power vacuum that can occur during the change of leadership has become an important issue, and various plans have been conceived to date. The work of the Presidential Transition Committee is a representative example of these efforts, and as the new president-elect's five year governing plans are established during this transitory period the attention of the media tends to be focused on this period. However, it seems that the activities of the committee have not always been evaluated favorably. Given this background, this thesis aims to investigate the problems in the systems involved in the changes of regime centering the Presidential Transition Committee from the public law point of view.
In the existing law, the duties of the committee are divided into the following four areas: ascertaining the organizational and functional side of the government and grasping the budget situation; preparing for key policies of the new government; preparing for the presidential inauguration and related duties, and other issues to be tackled for the change-over of presidency. In fact, the range of the activities of the transition committee varies according to the experience of the new president-elect and his commitment to carry out his presidential duties, and also his relationship with the previous president. For example, the Kim Young-Sam government emphasized the importance of becoming a civilian government focused on democratization, and the Kim Dae-Jung government had the characteristics of an emergency government because of the economical crisis of the time, and these trends were obviously reflected in the structure and activities of the transition committee. The Roh Moo-Hyun government declared itself to be a participatory government and invited the involvement of all classes of society. The present government, on the other hand, through the presidential undertaking committee, planned a complete rupture in relations with the preceding government, introducing a large scale reform of the government structure.
The current system of a five-year single-term presidency has made the preparations for a change of president an important national process. Based on experience so far, laws regarding the transition have also been enacted. The activities of the Presidential Transition Committee are very important for enabling presidential duties to be carried out successfully. So far it could be said that the committee's activities have been increasingly systematic and committed. Only a small part of its work has been criticized as ill-prepared, because of over-enthusiasm.
Transition is not a one-sided process, but must be a cooperative process between the previous and in-coming governments for a smooth succession and development of new governmental policies. For this, an organization to allow the previous government to cooperate with the new government is necessary and policies are also needed for the transition procedure. This thesis suggests improvements in the structures and operational methods for the system of presidential transition, examining the committee's operational experiences to date and analyzing similar examples in other countries including the USA. A committee to oversee the hand-over from the previous to the present government as a dialogue partner to the transition committee, the enactment of new procedural rules, and a transition agreement as a formality are all suggested in this thesis.
Considerable powers are granted to a Korean president and for his five-year term to be effective, a successful operation of the Presidential Transition Committee will be the starting point. The difficulties currently involved in the work of the committee could be said to have originated in the radical rupture from the previous government and a radical change in the membership. The new government should properly approach presidential duties through the transition committee, respecting the experiences of the previous government in national administration. Only then will important national and social development be possible.
