신용장 사본의 통지와 매입의 법률적 효력에 관한 연구 (A study on the Legal effect for Advising and Negotiation of Letter of Credit Copy)

초록

신용장 사본과 원본은 법률적 효과가 다르게 나타난다. 신용장 사본과 원본을 법률적 효력이 동일하다고 판단한 대법원의 판결은 시정되어야 한다. 스위프트로 개설되는 신용장의 원본은 시스템에서 출력되어 종이서류에 통지은행의 도장과 명판 또는 팩스로 통지할 경우에는 원본대조필이 기재되어 있어야 하고 무역EDI로 통지할 경우에는 공인전자서명이 있어야 한다. 통지은행의 도장과 명판 또는 원본대조필, 공인전자서명이 없는 신용장은 사본으로 본다. 신용장 사본의 통지와 매입은 UCP600에서 효력이 없다. 신용장 사본으로 발생되는 피해를 방지하기 위하여 개설은행, 수입상은 신용장에 다음과 같이 명시하여야 한다. 첫째, 수익자는 신용장에 신용장 원본과 선적서류를 함께 매입은행에게 제시하도록 명시한다. 둘째, 수입상은 신용장에 해상운송인을 지정하고 부지문언이 기재된 선하증권은 수리할 수 없다고 기재하여야 한다. 셋째, 수입상은 개설은행이 제시한 서적서류를 엄격하게 하게 심사하고 선적서류의 수리여부를 5은행영업일 이내에 결정하고 그 결정 사항을 개설은행에게 5은행영업일 이내에 통지하여야 한다.

영어초록

The Letter of Credit Original and The Letter of Credit Copy have very different legaleffect. It is to be corrected that the Supreme Court judge that the Letter of CreditOriginal and the Letter of Credit Copy have same legal effect. The Letter of CreditOriginal opened by SWIFT must to be beared the symbol of name on the Letter ofCredit printed from SWIFT. If advise the letter of Credit by FAX, The advising bankmust marked as original on the Letter of Credit printed from SWIFT. The issuing bankand advising bank exchange the authorized signature booklet and test key, after theissuing bank and advising bank agree correspondent agreement. The issuing bankmust open the letter of credit at the request of the applicant. The issuing bank sendsthe advising bank the test key and requests the advice of the letter of credit. Theadvising bank must advise the origin of the letter of credit. The advising bank doesnot advise the copy of the letter of credit. The negotiating bank must examine thepresentation to determine, on the basis of the documents alone, whether or not thedocuments forwarded by beneficiary appear on their face to constitute the terms andcondition of the credit, the applicable provisions of these rules and internationalstandard banking practice. The beneficiary must present the origin of the letter ofcredit to examine the documents. The issuing bank and the applicant must indicateon the letter of credit that the beneficiary present the origin of the letter of credit withdocuments. The applicant must indicate on the letter of credit the ocean carrierappointed by the applicant. The applicant must indicate on the letter of credit that atransport document bearing a clause such as shipper’s load and count, and said byshipper to contain is not acceptable. The applicant must examine the documentspresented by the issuing bank strictly within five banking days.
