인도네시아 가사노동자 권리보장운동과 제도-타협 실천 (Indonesian Domestic Workers’ Rights Advocacy Movement and Institutional Compromise Practice)

초록

이 연구는 인도네시아의 건국, 국가 운영 원칙인 판차실라의 시민사회 단위의 실천 사례로 가사노동자 권리보장운동을 분석한다. 판차실라의 원칙 중 ‘협의와 대의의 지혜를 바탕으로 한 민주주의’는 인도네시아 사회의 여러 단위에서 민주주의 실천 방법으로 구체화됐다. 이와 동시에 판차실라 민주주의의 개념은 지나치게 모호하여 자의적인 해석에 의해 남용되거나 구체적인 실천에 적용할 수 없다는 비판이 존재한다. 이 연구는 시민사회 단위에서 판차실라 민주주의 실천 방법으로 제도-타협 실천을 개념화하고 이를 통해 권리보장운동의 목적과 전략, 실천을 분석한다. 제도-타협 실천은 인도네시아의 주요 정치, 사회 제도를 비판하고 변화를 요구하는 시민사회의 민주주의 실천에서 주요 제도와 타협하는 실천을 의미한다. 인도네시아에서 가사노동자는 대표적인 비공식, 불안정 노동자로 인식되는 가운데, 권리보장운동은 이들의 비공식성과 불안정성을 지속, 확대시키는 주요 제도와 갈등하기보다 적극적으로 타협하며 운동의 목적을 실현하고자 한다. 권리보장운동의 제도-타협 실천은 권리보장법안의 내용과 집회 도구 및 발언 내용, 제도 정치권과의 타협 과정 등에서 발견된다. 이러한 실천은 효과적인 소수자 운동 전략으로 평가할 수 있지만, 당사자의 절박한 문제를 도외시한 엘리트 중심 실천 전략이라는 비판을 받을 수 있다. 판차실라 민주주의의 시민사회 단위 실천 방법인 제도-타협 실천을 통해 가사노동자 권리보장운동이라는 구체적 사례를 분석한 이 연구의 결과는 판차실라 민주주의에 대한 비관적 비판에 반박하며, 인도네시아 사회의 다중적 스케일에서의 판차실라 민주주의 구현 과정에 대한 후속 분석을 요청한다.

영어초록

This study analyzes the practical cases of Indonesian domestic workers’ rights advocacy movement as a manifestation of the founding and governing principles of Pancasila in civil society scale. One of the principles of Pancasila, “democracy guided by the inner wisdom in the unanimity arising out of deliberations among representatives,” has been concretized as a method of practicing democracy in various units of Indonesian society. However, criticism exists regarding the ambiguity of the concept of Pancasila democracy, suggesting that it can be subject to arbitrary interpretations and may not be readily applicable in specific practices.
This research conceptualizes the “institutional compromise practice” within civil society scale as a method of realizing Pancasila democracy and employs it to analyze the objectives, strategies, and practices of rights advocacy movement. Institutional compromise practice involves engaging with major political and social institutions while criticizing and demanding change in those institutions in Indonesia. In a context where domestic workers are predominantly perceived as informal and precarious laborers, the rights advocacy movement seeks to actively negotiate and compromise rather than confront the major institutions that perpetuate their informality and precarity in order to achieve its main objectives. The practice of institutional negotiation within the labor rights movement is evident in the content of rights advocacy legislation, the tools and content of protests and demonstrations, as well as the negotiation processes with institutional political institutions. This practice can be evaluated as an effective strategy for a minority movement, but it also faces criticism for being elitist and potentially disregarding the urgent issues faced by the domestic workers.
By analyzing the specific case of domestic workers’ rights advocacy movements through the lens of institutional compromise practice, this study counters pessimistic criticisms of Pancasila democracy and calls for further analysis of the implementation of Pancasila democracy at the various scales of Indonesian society.
