고등학교용 「위더피플: 시민과 헌법」 기본권 단원(19장·20장·29장·30장) (The translation of lessons related fundamental rights in 「We the People: The Citizen & the Constitution」 for high school)

초록

미국과 우리나라의 교과서는 그 구현 내용과 위상이 다르다. 때문에 양국의 교과서를 수평적으로 비교하는 것에는 무리가 있다. 우리나라에는 국가 주도 교육과정 및 그것을 충실하게 구현하는 교과서가 있으며, 그 교과서의 위상은 수능 시험의 기초 자료가 되는 등 위상이 높은 편이다. 반면, 미국은 상대적으로 교육과정 및 교과서가 자유로운 형태를 띠며, 교과서는 보조 자료의 위상을 가지고 있다.
그럼에도 불구하고, 미국의 시민교육 교재 「위더피플」에는 눈여겨 볼 대목이 존재한다. 「위더피플」은 미국 시민교육센터에서 발행하는 헌법 중심 시민교육 교재로써, 헌법의 가치와 내용을 역사적 관점으로 서술하고 있는 헌정사 교육의 사례이다. 이러한 형태의 교재 서술 방식은 우리나라 법교육이 ‘법학개론의 축소판’이라고 비판받는 현실에 시사점을 준다. 「위더피플」 교재의 장점을 취해 우리나라 헌법교육 교재 제작에 활용된다면 법교육 발전 측면에서 의의가 있을 것이다.
본 연구의 목적은 고등학교용 「위더피플」 교재의 기본권 관련 단원을 번역하는 것이다. 기본권은 헌법교육의 가장 핵심 내용이다. 또한 기본권 보장은 민주주의 실현을 위한 필수 요소이기도 하다. 이것이 「위더피플」 교재 내용 중 기본권 관련 단원을 먼저 살펴보는 이유이다. 본격적인 번역에 앞서 Ⅰ장에서는 「위더피플」 교재를 번역하는 이유에 대해 제시하였다. Ⅱ장에서는 고등학교용 「위더피플」 교재의 구성과 목차를 정리하였다. Ⅲ장에서는 번역의 실제를 제시하였다. 번역 단원의 주제는 평등 보호 조항(19장), 투표권(20장), 표현의 자유(29장), 집회·청원·결사의 자유(30장)이다.

영어초록

Textbooks in the United States and Korea differ in their implementation content and status. Therefore, it is unreasonable to compare textbooks of both countries horizontally. In Korea, there is a national-led curriculum and a textbook that faithfully implements it. The status of the textbook is high, such as being the basic data of the government-sponsored scholastic aptitude test &#40for university admission&#41. On the other hand, the United States has a relatively free curriculum and textbooks, and textbooks have the status of supplements.
Nevertheless, there is a point to look at in the American civic education textbook 「We the People」. 「We the People」 is a civic education textbook centered on the constitutional contents published by the US The Center for Civic Education. It is an example of constitutional history education that describes the value and content of the Constitution from a historical perspective. This type of textbook description suggests the reality that Korean law-related education is criticized as a microcosm of the Introduction to Jurisprudence. If we take advantage of 「We the People」 and use it to write constitution education textbooks, it will help develop law-related education.
The purpose of this research is to translate fundamental rights related lesson of the 「We the People」 textbook for high school. Fundamental rights are the most important content of constitution education. In addition, guarantee of fundamental rights is also a necessary element for realizing democracy. This is why we first look at the fundamental rights related lesson of the 「We the People」 textbook in this research. Before translation in earnest, we presented the reason for translating the 「We the People」 textbook&#40Ⅰ&#41. And we organized the composition and table of 「We the People」 textbook for high school&#40Ⅱ&#41. Finally, We presented the practice of translation&#40Ⅲ&#41. The theme of the translation is the equal protection clause&#40Lesson 19&#41, the right to vote&#40Lesson 20&#41, freedom of, freedom to assemble, prtition, and associate&#40Lesson 30&#41.
