개정 「납세자권리헌장」에 대한 소고 (A Study on the Revised “Taxpayers' Rights Charter”)

초록

납세자권리헌장과 그 내용의 고지는 납세자가 세무조사 등 세무공무원과 대면하는 상황에서 가장 먼저 자신의 권리(의무 포함)를 확인할 수 있는 수단 및 절차라고 할 수 있다. 우리나라는 이러한 납세자권리헌장을 1997.6.30. 최초 개정 고시한 후 2007.3.3. 한 차례 소폭 개정하고, 2018.2.1. 전면 개정 한 바 있다.
이 글은 전면 개정된 납세자권리헌장에 대한 구체적인 평가를 위해, Ⅱ장에서는 미국, 영국, 일본, 호주, 프랑스, 이탈리아, 캐나다, 뉴질랜드 등의 납세자헌장과 OECD 납세자헌장, 전문가단체의 모델 납세자헌장 등을 분석하여 시사점을 도출한다. 그리고 Ⅲ장에서는 실질적인 납세자권리 증진을 위한 내용적 개선방안, Ⅳ장에서는 납세자의 이해를 돕기 위한 형식적 개선방안을 검토한다. Ⅴ장에서는 앞서 정리한 개선방안을 2018.2.1. 전면 개정된 납세자권리헌장의 구체적인 내용과 비교ㆍ검토하고, Ⅵ장에서 지금까지의 논의를 요약정리한 후 개정 납세자권리헌장에 대해 평가한다.
2018.2.1. 전면 개정된 납세자권리헌장은 2007년 3월 이후의 국세기본법 개정내용을 담았다는 점, 세무조사의 절차에 따라 구성을 하였고 항목번호를 삭제하였다는 점, 전문과 요지의 구분을 없앴다는 점 등이 특징이라 할 수 있다. 납세자의 권리를 강화한 국세기본법 개정사항을 충실히 반영했다는 점에서 개정 납세자권리헌장은 납세자의 권리강화에 기여하였다고 평가할 수 있다.
추상적이고 모호한 표현을 줄이고 법령의 키워드, 사례를 간단히 서술하여 납세자가 이해하기 쉽게 개정한 점, 항목번호를 부여하지 않고 일반적인 서술 형식으로 개정하여 기존 법조문 형식에서 오는 납세자의 거부감을 줄이고 권리헌장의 품격을 높이고자 한 점, 세무조사의 진행 단계에 맞추어 납세자가 알아야 할 권리를 서술하여 사용편의를 제고한 점 등은 형식상 진일보한 납세자권리헌장 개정이라 할 수 있다. 다만 이 글에서 제시한 형식적 개선방안인 조사공무원의 명함 뒷면의 활용, 사용자별 다른 양식의 사용, 국세청 홈페이지 상 각종 카드형(대형, 소형 등) 헌장의 게재, 법령용/고지용/낭독용의 구분, 납세자권리헌장 주요 사항의 동영상 제공 등은 개정 납세자권리헌장 하에서도 반영할 수 있는 부분이라 할 수 있다.
한편 실질적인 납세자 권리증진을 위한 내용적 개선방안으로 고려할 수 있는 사항으로 주요국 입법례 분석을 통한 새로운 유형의 권리 반영, 대법원의 세무조사에 대한 납세자의 절차적 권리 반영, 성실성 추정의 원칙과 협력의무 등에 대한 보완, 과세권 제약시 일부 납세자의 조세회피ㆍ탈세 등의 효과적 대응을 위한 납세자의 성실성 추정의 배제와 입증책임의 일부 전환 등이 반영되지 않은 점은 아쉬운 부분이라 할 수 있다.

영어초록

The taxpayers' rights charter and its notification can be considered as means and procedures for taxpayers to identify their rights(including obligations) first in the situation of facing revenue officer such as tax investigation. In Korea, the taxpayers' rights charter was first revised and notified on June 30, 1997, it was slightly revised on March 3, 2007, and it was completely revised on February, 1, 2018.
This study analyzes the taxpayers' rights charter of such countries as the US, the UK, Japan, Australia, France, Italy, Canada and New Zealand along with OECD's right charter of taxpayer and specialist groups' model of the taxpayers' rights charter and deducts implications in the chapter Ⅱ for detailed evaluation on the completely revised taxpayers' rights charter. The chapter Ⅲ reviews the content improvement plan for promotion of practical taxpayer rights, and the chapter Ⅳ considers the formal improvement plans to help taxpayers to understand. The chapter Ⅴ compares and reviews the improvement plans mentioned above with the specific contents of the taxpayers' rights charter completely revised on February 1, 2018. The chapter Ⅵ summarizes the discussions so far and evaluates the revised taxpayers' rights charter.
The characteristics of the taxpayers' rights charter that was completely revised on February 1, 2018 include such facts as it contains the revised contents of Framework Act on National Taxes after March of 2007, it is constituted according to the procedures of tax investigation and removes item numbers, and it removes the division between full text and summary. The revised taxpayers' rights charter can be regarded to contribute to strengthening taxpayers rights in that it fully reflects the revised matters of Framework Act on National Taxes that reinforces taxpayers rights.
It can also be considered as the advanced revision of the taxpayers' rights charter for form's sake in that it briefly describes key words and cases of laws by reducing abstract and ambiguous expressions for easy understanding of taxpayers, it is general description form without granting item numbers to reduce taxpayers' repulsion from the existing judicial sentences and to enhance dignity of the right charter, and it describes rights that taxpayers should know to improve convenience by following the procedures of tax investigation. However, the volume two of the revised taxpayers' rights charter should reflect the formal improvement plans presented in this study such as use of the back of investigation officials' name cards, use of different forms per each user, insertion of card type(large, small, etc.) right chart in the website of National Tax Service, division of uses for legislation/notification/reading, and supply of video clips on major matters of the taxpayers' rights charter.
Meanwhile, this study lacks matters that can be considered as content improvement plans for strengthening actual rights of taxpayers such as reflection of new types of rights analyzing major countries' legislation cases, reflection of procedural rights of taxpayers on the supreme court's tax investigation, compensation of the faithfulness assumption principle and cooperative duty, partly transition of exclusion of taxpayers' faithfulness assumption and burden of proof for effective handling of some taxpayers' tax avoidance and tax evasion.
