형식적 자유로부터 실질적 자유로의 접근과그 한계 -롤즈의 자유주의 이론을 중심으로- (A Study on the Expansion of the Notion of Formal Freedom to Substantive Freedom - focused on the Rawls’ Theory of Liberalism -)

초록

수많은 혁명과 인권 선언과 같은 역사적 과정을 거치면서 모든 인간은 자유롭고도 평등한 주체으로서의 삶을 지향하여 왔다. 그러나 자본주의의 전개에 따라 계층 간 경제적·사회적 불평등이 심화되면서, 우리가 그동안 바라왔던 자유와 평등을 누리는 삶으로부터 점차괴리되고 있음을 절감하고 있다. 이 글은 모든 성원이 명문에 새겨진 형식적 자유를 획득한존재에 그치는 것이 아니라, 수많은 실천을 통해 애초에 바라왔던 자유와 평등의 가치를자신의 삶 속에서 구체적으로 영위해가는 존재로 거듭나는 것이 필요하다는 문제의식을지니고 있다. 이를 위해 근대 이후 자유주의의 흐름을 검토하면서 모든 성원에게 자유롭고평등한 삶의 영역을 사회적으로 보장하기 위해서는 어떠한 문제들이 검토되어야 하는지실질적 자유의 관점에서 살펴보고자 한다. 이 글은 근대 이후 자유주의의 흐름 가운데 우선형식적 자유를 강조하였던 이사야 벌린과 노직의 이론, 그리고 형식적 자유로부터 실질적자유의 보장에 접근한 롤즈의 이론까지 검토하면서, 그 의미와 한계로부터 모든 성원이 실질적 자유를 누리는 삶에 한발짝 더 다가가도록 보장하기 위해 검토하여야 할 사항들을도출한다.
벌린과 노직의 자유주의 이론이 견지하는 형식적 자유의 인정만으로는 부당한 자유의 침해와 부정의한 상태가 구조화하게 된다. 롤즈는 이처럼 형식적 자유의 보장만으로는 시장 체제에서 모든 개인들의 자유로운 삶이 유지될 수 없다는 점을 인지하였다. 이에 그는차등의 원칙, 배경적 제도 등을 통해 형식적 자유로부터 실질적 자유로의 확장을 시도한다.
그러나 기본적 자유를 시민적·정치적 자유에 한정하는 등 여전히 형식적 자유를 강조하는기존 자유주의 이론의 틀에서 크게 벗어나지 않는 것으로 보인다. 따라서 롤즈가 제안하는정의의 체계에서도 모든 성원이 자신의 삶 속에서 타자와 동등하게 자유와 평등의 가치를누리는 데로 나아가기는 어렵게 된다. 이에 개인의 삶에 보다 중점을 두고 실질적 자유의보장에 대해 본격적으로 다루는 이론들이 등장하는 계기를 맞는다

영어초록

Throughout numerous revolutions and historical processes, such as the declaration of human rights, every human being has been recognized as a free entity with equal rights.
However, as capitalism developed and spread across the world, economic and social inequality between classes intensified. As a result, people now feel more deeply than ever that we are departing from a life of freedom and equality which we have long sought. This article makes the argument that every member of society is not just a being which has obtained formal freedom as stipulated by law but that they also need to be reborn as beings that achieve freedom and equality in life through repeated practices.
To this end, this article examines the flow of liberalism in modern times to understand which problems should be considered in the context of substantive freedom in order to guarantee freedom and equality to every member of society in their life. Furthermore, this article examines the theories of Isaiah Berlin and Robert Nozick which emphasized formal freedom among the trends of liberalism after modern times. It will also consider the theory of John Rawls, which differentiated the guarantee of substantive freedom from formal freedom while examining the meaning and limitations of such theories to develop a philosophy in which every member of society can lead a free and equal life.
Simply recognizing the formal freedom which is described by the liberalism theory of Berlin and Nozick would structuralize the unjust infringement upon freedom and perpetuate a state of injustice. However, Rawls argued that every individual cannot maintain a free life under the market system simply through the guarantee of formal freedom. Rawls made an attempt to expand the notion of formal freedom to substantive freedom through the difference principle, background institution , and so on. Still, Rawls’ work does not seem to deviate much from the framework of Berlin and Nozick’s liberalism, which emphasizes formal freedom by restricting basic liberty to civil/political liberty, and so on. In this regard, under the system of justice proposed by Rawls, it is difficult for every member of society to achieve substantive freedom at the equal level as others in their life. As a result, theories covering the guarantee of substantive freedom in earnest while focusing more on the life of an individual began to appear.
