채권자대위소송에 관한 연구 (The Study on A ction for Obligee's Subrogation Right)

초록

채권자대위소송은 민법상 채권자대위권을 재판상 행사하는 것으로 책임재산보전을 목적으로 활용되는 것보다도 채권회수기능을 통해 사실상 우선변제를 받는 방식으로 대법원도서관의 검색목록에서도 볼 수 있는 바와 같이 법률가들은 이에 대하여 매우 관심이 많고그 활용도 또한 매우 높은 것이 현실이다. 따라서 이 글은 그 활용도 측면에서 초점을 맞추어 진행하였다. 그런데 여기에서 우선적으로 해결되어야 할 것이 이 소송의 등장인물 중3자 중 하나인 채무자의 소송상 역할문제이다. 판례는 전원합의체의 결론에 따라 관리처분권이 채무자로부터 채권자에게 넘어가 법정소송담당의 형태로 채무자의 당사자적격을 부정하고 있어 원칙적으로 당사자로서 채권자대위소송에 참여할 수 없어 채권자의 소송수행의 정도에 따라 채무자의 권리보호에 문제가 발생할 우려가 있음을 부인할 수 없다.
위와 같은 점을 유념하면서 이 글은 채권자대위소송의 기본적인 틀로서 채권자대위소송의 형태로 본래형과 전용형의 채권자대위소송을 제시하고 명문규정이 없는 전용형의 채권자대위권의 존재방식을 검토한 다음 채권자대위소송에 있어서 그 구조를 이해하고 채권자가 받은 확정판결의 채무자(피대위자)에 대한 효력에 관하여 판례를 중심으로 검토하였다.
그 이후에 채권자대위소송 계속 중에 채무자의 별소 제기 가부를 연구하고 가사 원·피고의당사자로 참여할 수 없는 경우 채무자의 이익보호 등을 위하여 채무자에 의한 소송참가방식을 연구하였다. 그리고 최종적으로는 위와 같은 이론적·실무적 논의를 마친 다음 채권자대위소송에 있어서 요건사실을 파악하여 실제로 채권자대위권을 실무적으로 활용하는데도움을 줄 수 있도록 하였다.

영어초록

The Action for Obligee`s Subrogation Right means exercising the right to subrogate obligor under civil law in court.
It is a fact that it receives virtually priority payment by using the debt collection function rather than being used for the purpose of preserving chargeable properties. As can be seen in the search list of the Supreme Court Library, lawyers are very interested in this and unlike other countries, the utilization is also very high in reality. Therefore, this paper focused on its utilization rate. However, being resolved preferentially here is the question of the role of the obligor in litigation, which is one of the three among the characters in this case. According to the conclusion of the En Banc, all cases deny the eligibility of the obligor as a party in the form of a litigation charge in which the right of control is transferred from the obligor to the obligee, and as a general rule, participate in the Action for Obligee`s Subrogation Right. From the standpoint of the obligor who can not do it can not deny that there is a possibility that problems may arise in the protection of the rights of the obligor depending on the degree of the obligee's execution of the lawsuit.
While paying attention to the above points, in this paper, as a basic framework of the Action for Obligee`s Subrogation Right, an essential type and dedicated type of the Action for Obligee`s Subrogation Right is presented and stipulated clearly. Examining the way of the Action for Obligee`s Subrogation Right, we examined the effect of obligor of the final judgment received by the creditors under the understanding of the structure in the Action for Obligee`s Subrogation Right, focusing on judicial precedents. Afterwards, if you can not participate as a party to separate complaint's defendant by studying the possibility of appeal of another obligor's appeal while under petty for creditors' proceedings, in order to protect the interests of the obligor, etc. I studied lawsuit participation method. Ultimately, after finishing the theoretical·practical discussion as above, we grasp the requirement facts in the Action for Obligee`s Subrogation Right and give them usefulness to actually utilize the Obligee`s Subrogation Right in practice.
