주택임대차보호법상의 임차인 보호제도에 관한 법적 고찰 (Housing Lease Protection Act, tenants on the legal Study on the Protection System)

초록

주택임대차보호법은 경제적 약자인 임차인의 보호를 위해 1981년 처음 제정되었으며 최근까지 수차례에 걸쳐 일부 개정이 있었다. 주택임대차보호법은 민법으로는 임차인의 보호에 미흡해 이를 보완하기 위해 제정된 특별법이다. 하지만 사회환경과 제도가 계속해서 바뀌고 있는 현대사회에서 임차인 보호에 미흡한 면이 발생하고 있고 임대차제도의 안정을 위해서는 주택임대차보호법도 보완이 필요하다. 그래서 주택임대차보호법상의 임차인보호제도 중 주택임차권의 대항력, 우선변제권, 경매에서 임차인의 배당요구권 등의 내용을 살펴보고 각 제도의 미흡한 점과 개선방안을 검토하였다. 각 제도의 개선방안으로는 첫째, 주택의 인도와 주민등록이라는 두 요건이 구비되어도 ‘즉시’ 대항력의 효력이 발생하지 않아 임차인이 경제적, 사회적으로 피해를 입는 경우가 많이 발생하므로 위 조항의 ‘그 다음날’이라는 규정은 삭제되어야 할 것이다. 둘째, 상가건물임대차보호법에 규정되어 있는 계약갱신요구권을 주택임대차보호법에 도입하기 위한 개정은 임대인의 재산권 침해의 이유로 보류되고 있다. 이에 계약갱신요구권 도입의 필요성을 주거권(안정성)․계속성(지속성)․재산권의 보장을 중심으로 한 법적 당위성에 대하여 규명함으로써 향후 개정에 적극적으로 반영될 수 있도록 하여야 한다. 셋째, 임차인들 중 대항력이 없는 후순위 임차인에 한해 전입과 확정일자를 갖추었다면 배당요구 신청을 하지 않더라도 배당신청을 한 것으로 인정해야 한다. 현재의 임대시장은 보증금의 이상 급등과 그로 인한 주거형태의 변화로 많은 문제점이 발생할 위험에 노출되어 있다고 볼 수 있다. 따라서 임차인의 주거안정과 임대차보증금의 반환을 보장하기 위하여 앞에서 언급한 문제점들이 개선되어 주택임대차가 하루 속히 안정적으로 정착되기를 기대한다.
