외국인의 주택임대차보호를위한 대항요건에 관한 고찰 (A study on requirements of opposing power for Housing Lease Protection of foreigners)

초록

현재 국내에는 국제 교류로 인하여 체류 외국인이 하루가 다르게 증가하여국제 사회화 시대를 맞이하고 있다. 즉 외국인 관광객, 사업가, 근로자, 유학생등의 국내유입이 증가하면서 다문화 사회를 형성하게 되었다. 따라서 내국인중심의 법률과 제도를 내국인과 외국인이 함께 어울릴 수 있도록 정비하고 운용할 것이 요구되는 상황이다. 외국인의 지속적인 증가는 거주공간으로서의주택에 대한 수요의 증가로 이어진다. 이러한 외국인의 국내체류 증가에 따른주택임대차보호와 관련된 문제점과 개선방안을 살펴보면 다음과 같다.
첫째, 주택임대차보호법상 외국인의 대항력 규정 부재의 문제점이다. 이에대한 개선방안으로 이법에서 외국인의 대항력 보호조항을 신설하여 출입국관리법 적용대상 외국인도 이법을 준용한다는 내용을 명시해야 한다. 그렇게 함으로써 판례를 인용하여 대항력 보호여부를 판단할 필요성이 없을 것으로 생각 되므로 조항 신설이 필요하다.
둘째, 외국인 전입세대 열람권 제한의 문제점이다. 주택임대차계약서상 확정일자를 받고 출입국관리법 규정에 의하여 전입신고를 한 것으로 간주하는외국인도 전입세대 열람내역에 전부 나타날 수 있도록 관련법을 개정이 필요하다. 외국인 전입세대도 ‘주민등록법 시행령’관련 규정을 준용하여 열람자격을 주장할 수 있어야 한다. 왜냐하면, 외국인은 주민등록과 전입신고가 불가능함으로 출입국관리법을 근거로 대항력은 보호하고 있으면서 전입세대 열람이불가능 하다는 것은 문제가 있다고 보기 때문이다. 그러므로 주민등록법 시행규칙에 따라 주민등록전입세대의 열람 조항에는 출입국관리법상 외국인들도전입세대 열람을 직접 신청 할 수 있도록 조항 신설이 필요하다.
이와 같이 외국인에 대한 대항요건에 관한 문제점들에 대하여 개선방안을제시하여 보았다. 향후 이런 문제점들이 외국인들에게 ‘출입국관리법’상의 주택임대차 보호 규정을 적용할 것이 아니라 주택임대차보호법과 주민등록법에서 보호받을 수 있도록 법 개정이 필요할 것으로 생각된다.

영어초록

The number of foreigners who inhabit Korea is gradually increasing arised frominternational exchange, entering the age of international socialization. An increasingnumber of foreign tourists, businessmen, workers and students in Korea has led to theformation of a multi-cultural society. It is, therefore, required to revise and operatelocals-oriented laws and systems so that Koreans could coexist with foreigners who, ifnot necessarily, are made to demand housing as residential space. The problems andimprovement plans of the Housing Lease Protection caused by increase in thelong-term stay of the foreigners are examined as follows.
First, what matters most is inadequate regulations of opposing power for theforeigners under the Housing Lease Protection Act Enforcement Regulations. It is,thus, required to establish a requisite protection clause on opposing power of theforeigners, which is to specify that foreigners subject to the Immigration Control Lawshall comply with this law.
Second, what comes into question mostly is not granting the right to inspection oftransfer household for foreigners. It is necessary to revise the related laws so thatforeigners, who are considered to receive a definite date in the housing lease contractand to register a transfer report in accordance with the Immigration Contral Law,should be included in the statement of transfer household report. It should be allowedfor foreign residents to demand the right to open the transfer household report byapplying Enforcement Decree of the Residents Registration Law. Foreigners ‘gettingopposing power based on the Immigration Control Law is inconsistent with the fact that it is not allowed for foreigners to open a transfer household report for the reasonof their not being allowed to register the social number and transfer. It is, therefore,essential to newly establish and insert a clause concerning the right to open a transferhousehold report in the enforcement decree of the Residents Registration Law forforeigners under the Immigration Control Law.
This study suggested improvements to the problems related to the requisites forforeign residents. It is thought that these problems are to be solved through theamendment of the law of the housing lease protection, not through the compliancewith the Immigration Control Law.
