주택임대차분쟁 조정의 생존요인 분석 (An Analysis of Survival Factors of Housing Lease Dispute Mediation)

초록

주택 임대차 분쟁 조정위원회에서의 분쟁은 기간별로 생존율이 형성되고 조정안의 이행 기간에 따라 분쟁이 소멸될 수도 있고 생존될 수도 있다. 이에 본 연구에서 살펴본 주택임대차분쟁 조정과정에서 분쟁의 생존율과 생존기간에 미치는 영향요인을 분석한 결과는 다음과 같다.
첫째, 주택임대차분쟁 조정성립의 생존율은 2개월 종료시점에서는 47.3%, 3개월 종료시점에서는 31%가 생존하여 3개월 경과시점에서 69%의 분쟁이 소멸하는 것으로 나타났다. 이에 대해 조정위원회에서는 사건별 분쟁의 생존율을 고려하여 분쟁조정에 대한 이행 기간을 설정함에 상당한 검토가 필요함을 알 수 있다.
둘째, 분쟁의 생존기간에 미치는 영향요인을 분석할 결과, 대리인 존재, 조정기간, 조정가율, 소액임차인 존재, 사건명의 손해배상, 수선유지의무, 중개보수 등 6가지의 변수가 부(-)의 영향을 미치는 것으로 나타났다. 그러나 신청인지위, 사건명의 계약금반환, 계약이행, 계약종료, 보증금반환, 임대차기간, 주택반환 등은 영향을 미치지 않는 것으로 나타났다. 이에　조정위원회는 분쟁의 생존기간에 영향을 미치는 요소와 주변 환경을 고려한 조정안의 이행 기간 설정이 필요하다.

영어초록

Disputes in the Housing Lease Dispute Mediation Committee may or may not survive, depending on the duration of the mediation and the duration of the mediation. Accordingly, the results of the analysis of the factors affecting the survival rate and duration of disputes in the resolution of housing lease disputes in this study are as follows: First, the survival rate of housing lease dispute mediation was 47.3% at the end of the two-month period and 31% at the end of the three-month period, with 69% of the disputes disappearing at the end of the three-month period. In response, the Mediation Committee can see that considerable consideration is needed to establish a period of implementation for dispute settlement in consideration of the survival rate of disputes by case. Second, the analysis of the impact factors on the duration of the dispute showed that six variables, including agent existence, mediation period, adjustment rate, small lease existence, damage to the name of the case, maintenance obligation, and brokerage remuneration, had negative effects. However, the status of the applicant, the return of the contract under the name of the event, the execution of the contract, the termination of the contract, the return of the deposit, the lease period and the return of the house were not shown to affect. In response, the mediation committee needs to establish the implementation period of the mediation plan (book) considering the factors that affect the duration of the dispute’s survival and the surrounding environment.
