경자유전의 원칙과 농지임대차 (Land to the tillers principle and farmland lease)

초록

경자유전의 원칙(Land to the Tiller)은 농지는 경작자만이 소유할 수 있다는 원칙을 말한다. 헌법 제121조 제1항은 국가는 농지에 관하여 경자유전의 원칙이 달성될 수 있도록 노력하여야 하며, 농지의 소작제도는 금지된다고 하여 농지에 대한 경자유전의 원칙을 천명하고 있고, 소작제도를 금지하고 있다. 「농지법」 제6조 제1항은 농지는 자기의 농업경영에 이용하거나 이용할 자가 아니면 소유하지 못한다고 하여 이를 구체화하고 있다.
한편으로는 헌법 제121조 제2항은 농업생산성의 제고와 농지의 합리적인 이용을 위하거나 불가피한 사정으로 발생하는 농지의 임대차와 위탁경영은 법률이 정하는 바에 의하여 인정된다고 하여 ‘농업생산성 제고’, ‘농지의 합리적인 이용’을 위하여 제한적으로 농지 임대차와 위탁경영을 허용하고 있다. 그런데 농촌 고령화, 농업구조의 변화, 인구감소, 임차농지의 증가, 겸업농가의 증가 등으로 인하여 경자유전의 원칙보다는 현재는 오히려 제2항의 의의가 커지고 있다.
그런데 경자유전의 원칙은 기본적으로 소작제 금지와 연관되어 있다. 소작제 금지의 완전한 이상이 경자유전의 원칙인 것이다. 우리 헌법이 소작제 금지를 지속적으로 명시하고 있었으나 경자유전의 원칙은 1987년 헌법에서 처음으로 국가의 노력의무로 도입되었다는 점을 보아도 알 수 있다. 현대에 들어와서 농업환경의 변화 등으로 경자유전의 원칙을 관철하는 것은 사실상 불가능하다. 그렇지만 소작제 금지의 목적은 경자유전의 원칙의 고수를 통해서만 달성가능한 것이 아니라 「농지법」이나 농지임대차 제도 등을 통하여 실현 가능하다. 이를 위하여 「농지법」상으로 농지에 대한 엄격한 관리제도를 두고, 합리적인 농지의 임대차 제도를 마련하여 보완하여야 할 것이다. 이것이 헌법 제121조 제2항이 규정하고 있는 ‘농업생산성의 제고와 농지의 합리적인 이용’에 부합하는 농지제도일 것이다.

영어초록

Land to the tillers principle refers to the principle that only farmers can own farmland. Article 121 (1) of the Constitution states, “The State shall endeavor to realize the land-to-the-tillers principle with respect to agricultural land. Tenant farming shall be prohibited.” It clearly states land-to-the-tillers principle and prohibits the tenancy system. Article 6 (1) of the Farmland Act specifies this by stating, “Farmland shall be owned only by a person who uses or will use it for his/her own agricultural management.” On the one hand, Article 121 (2) of the Constitution states that “The leasing of agricultural land and the consignment management of agricultural land to increase agricultural productivity and to ensure the rational utilization of agricultural land or due to unavoidable circumstances, shall be recognized under the conditions as prescribed by Act.” In order to “increase agricultural productivity” and “rational utilization of agricultural land,” limited lease and consignment management of farmland are permitted. However, due to the aging of rural areas, changes in agricultural structure, population decline, increase in leased farmland, and increase in part-time farms, the significance of Paragraph 2 is currently greater than the land-to-the-tillers principle.
However, the land-to-the-tillers principle is fundamentally related to the prohibition of tenant farming. The perfect ideal of prohibition of tenant farming is the land-to-the-tillers principle. This can be seen from the fact that our Constitution has continuously stipulated the prohibition of tenancy, but the land-to-the-tillers principle was first introduced as a state duty of effort in the 1987 Constitution. In modern times, it is virtually impossible to enforce the land-to-the-tillers principle due to changes in the agricultural environment. However, the purpose of prohibiting tenancy can be achieved not only through the observance of the land-to-the-tillers principle, but also through the Farmland Act or the farmland lease system. To this end, a strict management system for farmland should be established under the Farmland Act and a reasonable farmland lease system should be established and supplemented. This would be an agricultural land system that conforms to the enhancement of agricultural productivity and rational use of farmland stipulated in Article 121 (2) of the Constitution.
