초록

규범성 내지 당위성의 근거와 기원에 대한 해명은 법철학에서의 고전 적인 탐구 주제 중 하나로서, Christine M. Korsgaard는 I. Kant 철학에 대한 재해석을 통해 규범성의 본성에 관한 독창적인 이론을 제시한다. 그가 시도했던 재해석의 핵심은 정언명법과 도덕법칙의 구분 및 실천적 정체성 개념을 통한 규범성 해명이다. 코스가드는 정언명법은 행위자에게 보편적으로 의욕가능한 준칙에 따라 행위할 것을 명령할 뿐 정언명법에 따른다고 하여 도덕적이게 되는 것은 아니며, 행위자가 도덕적이게 되는 것은 보편적 인간성의 가치를 반성적으로 승인하고 목적의 왕국의 일원으 로서의 실천적 정체성하에서 행위하게 될 때라고 본다. 코스가드의 재해 석에 대한 대표적 비판은 지나치게 비칸트적이라는 점이다. 이기주의적인 행위준칙이든 방종체(wanton)의 행위준칙이든 보편적으로 의욕될 수만 있다면 정언명법에 부합되게 채택가능하다고 함으로써 홉스의 군주에서 발견될 수 있는 입법상의 자의성 문제를 야기한다는 것이다. 본고에서 필자는 첫번째, 코스가드의 칸트 윤리학의 재해석을 분석적으로 검토하 고자 한다. 코스가드가 자신의 철학적 성찰의 출발점에 놓았던 규범성 물음의 면면을 살펴보고, 관련된 반성적 검증 절차를 검토할 것이다. 필자는 가급적 코스가드에 대해 우호적인 입장에 설 것인데, 필자는 비록 코스가드가 칸트철학을 바탕으로 자신의 주장을 제기하였다고 하여도 그와 칸트의 논점이 정확하게 부합해야 할 필요는 없으며, 비칸트적 요소들은 그것들 자체로 정당하게 평가받아야 한다고 본다. 필자가 두번째로 할 일은 도덕법칙과 분리된 정언명법이 행위자의 “모든” 행위와 관련하여 갖게 되는 보편법칙성의 의의를 살펴보는 것이다. 필자는 보편법칙성이 단순한 인과 행위자성이 아닌 자아 통합성에 기하여 이해될 때 그 적절한 의미가 주어질 수 있음을 반성적 방종체 사례를 통해 보여주고자 한다.

영어초록

Christine M. Korsgaard attempted a reinterpretation of I. Kant’s philosophy in The Sources of Normativity. She distinguished between the categorical imperative and the moral law, and explained the establishment of normative demands and obligations in connection with practical identities. The reason why she distinguished between the categorical imperative and the moral law is that the categorical imperative commands the agent only to act according to the universalizable maxims, and that following the categorical imperative does not make one moral. It is when we reflectively acknowledge the value of universal humanity and act with a practical identity as members of the kingdom of purpose that we become moral.
Korsgaard’s reinterpretation drew much criticism. A typical criticism is that it is too non-Kantian. The concept of practical identity comprises all elements that can be included in the answer to the question “Who am I?”. Korsgaard faced criticism for making the uniqueness of Kant’s philosophy disappear by saying that the egotistical rule of conduct or even the rule of wanton can also conform to the categorical imperative. The categorical imperative, separated from the moral law, raises the problem of arbitrariness in legislation that can be found in Hobbes’ monarch in the point that any rule of conduct can be adopted only if it can be willed in universalizable ways.
In this paper, I first try to review Korsgaard’s reinterpretation of Kant's ethics analytically. We will examine the particular aspects of the normative question placed at the starting point of her philosophical research, and of the test of reflection proposed as a methodological procedure to find an answer to the normative question. I would like to take a favorable stance toward Korsgaard as much as possible. Even if Korsgaard made her arguments based on Kant’s philosophy, her statements do not have to be exactly in line with those of Kant, and the non-Kantian elements should be justly evaluated in themselves.
The second thing I will do is to examine the meaning of universalizability that the categorical imperative separated from the moral law has in relation to “all” actions of an agent. I would like to show through the case of the reflective wanton that this universalizability can be given an appropriate meaning when it is understood in light of self-integrity rather than merely agent causality.
