지방자치단체 공휴일 지정에 관한 소고 (Legal Issue on designate local holidays)

초록

최근 정부는 ‘지방자치단체 공휴일에 관한 규정’을 공포하였다. 동 규정은 제주특별자치도의 4. 3사건을 기념하고 공휴일로 지정하고자 하는 제주특별자치도의회의 조례가 지방공휴일 지정이 상위법령의 근거의 부재가 문제되어 행정안전부가 이에 대한 근거를 마련하고자 지방공휴일에 대한 규정을 공포하였다. 결국 정부는 지방자치단체가 특정 지역에서 역사적․문화적으로 의미 있는 날을 지방공휴일로 지정할 수 있는 길을 열어주며, 지방자치단체의 고유성을 인정한 사례라 할 수 있을 것이다. 나아가 20대 국회에는 지방공휴일로 지정할 수 있는 내용의 법안들이 발의되어 있는 상태이다. 그러나 지방공휴일 관련 법률제정안들은 공휴일 법제화를 둘러싼 논의가 정리되지 않은 상황에서 현행 법제와의 관계에서 지방공휴일 근거 법률의 제․개정에 신중한 검토가 필요할 것이다.
영토가 크지 않고 경제성장을 하는데 효율적인 중앙집권적 시스템을 구축해온 우리 역사에 비추어 보았을 때, 중앙정부가 아닌 지방자치단체에서 특정 지방의 공휴일 지정이 가능하게 함은 지방분권강화의 표현으로 해석될 수 있다. 지방공휴일 지정사무가 지방자치법 제9조 제2항 제1호 다목에 따라 산하행정기관의 조직관리에 관한 자치사무로 볼 수도 있으나, 공휴일지정과 운영은 국민의 생활을 물론 국민의 권리․의무 관계에 영향을 미치는 사항이고 국가나 지방자치단체의 관공서가 쉬는 날이므로 전국적인 통일성 역시 고려해야 할 사항이다. 또한 우리나라 공휴일 제도의 특성상 공휴일은 관공서의 휴일을 의미하지만 공휴일을 비단 공무원의 휴일이 아닌, 일반 국민들이 쉬는 날로 인식하고 있음을 감안하면 지방공휴일 지정은 지방자치법 제11조에서 국가사무 중 해석상 근로기준으로 볼 여지가 있다. 그러나 근로기준법에서 사용자는 근로자에게 1주에 평균 1회 이상의 유급휴일을 보장하여야 한다고 규정하고 있을 뿐, 휴일을 구체적으로 명시하고 있지 않아 특정일이 아닌, 1주에 평균 1회 이상의 휴일을 지키면 되는 것이다. 따라서 지방자치단체장이 근무일을 변경하여 특정일에 근무를 하지 않도록 하는 것이 국가의 통일적 사무를 요하는 근로기준에 해당하지는 않는다. 일본 오키나와의 경우도 이와 유사하게 지방공휴일을 조례로 지정한 바 있으나, 주민들의 반발로 조례안을 폐지하고 일본정부는 지방자치법을 개정하여 최소한의 지방의 역사적 문화적 특성을 존중하고 있다.
나아가 지방자치단체의 고유성과 독립성을 인정한 본 지방공휴일에 관한 규정을 계기로 자치입법권의 확대에 대한 논의 역시 필요하다. 현실적으로 국회가 지방자치단체의 모든 여건을 감안하여 지방자치단체의 조례제정이 필요 없을 정도로 완벽하게 규정할 수도 없을 뿐 아니라, 지방의회가 주민의 선거를 통해 직접 정당성을 부여받았으므로 자치입법권을 확대할 필요가 있다. 물론 이를 위한 지방의회의 역량 강화 등의 점진적이고 실질적 노력이 필요할 것이나, 지방분권 강화는 지역주민의 참여를 이끄는 진정한 풀뿌리 민주주의를 실현하는 길이라고 생각한다.

Recently, the government has promulgated “Regulations on Local Government Holiday”. The appointment of a local public holiday may be regarded as self-government affairs related to the organizational management of administrative agencies under Article 9, Paragraph 2, Item 1, Paragraph 1 of the Local Autonomy Act, but the designation and operation of public holidays are not limited to the people's rights, And the national unity is also a consideration because it is the day when the government or the municipal government offices of the state or local governments take a break.
In addition, according to the characteristics of the national holidays system, public holidays refer to public holidays. However, considering that public holidays are not public holidays but public holidays, public holidays are designated as local holidays. Article 11 of the Local Autonomy Law There is room to see. However, in the Labor Standards Act, the employer stipulates that an average of one or more paid holidays per week should be guaranteed to a worker, and if the worker does not specify the holidays specifically, will be. Similarly, in Okinawa, Japan, local holidays were designated as ordinances, but the ordinance was abolished by the residents' opposition, and the Japanese government revised the Local Autonomy Law to respect at least the local historical and cultural characteristics.
Furthermore, it is necessary to discuss the expansion of self-governing legislative power with the provision of local holidays, which recognize the uniqueness and independence of local autonomous entities. In reality, the National Assembly can not fully prescribe the regulations of the local autonomous bodies in consideration of all the circumstances of the local autonomous bodies, and the local councils have been given the legitimacy through the election of the residents. There is a need. Of course, gradual and practical efforts such as strengthening the capacity of the local councils will be necessary, but I think that the strengthening of decentralization is the realization of genuine grassroots democracy leading to the participation of local residents.
