미국의 특별수요신탁에 관한 일고찰 (A Study on Special Needs Trusts in USA)

초록

장애인, 특히 중증장애인의 경우 비장애인에 비해 일상생활 영위를 위한 소득원이 충분하지 않는 경우가 많다. 현행 장애인 소득보장제도에는 국민연금의 장애연금, 장애인연금법상의 장애인연금, 장애인복지법상의 다양한 장애수당제도가 있지만, 금액 면에서 미흡할 뿐만 아니라 장애인의 다양한 개별적인 수요를 충족하는 데에도 한계가 있다. 장애인의 개별적인 수요를 고려한 이른바 맞춤형 서비스 제공을 가능하게 하는 제도로는 신탁제도를 고려할 수 있다.
이에 미국에서의 장애인신탁인 특별수요신탁이 많은 시사점을 줄 수 있다. 특별수요신탁은 신탁출연재산이 자산조사형 공공부조 수급자격 검토시 자산에 계산되지 않음으로써 장애인이 신탁설정으로 인해 공공부조 혜택을 방해받지 않도록 설계되었다. 특히 집합특별수요신탁의 경우 1~2억 원 정도의 재산만을 남길 수 있는 중산층 이하 저소득층 장애인 가족들에게 매우 유용한 제도이다.
우리의 경우도 장애인의 특별한 수요를 위하여 사용할 목적으로 출연된 신탁자금은 국민기초생활보장법상의 재산에 포함시키지 않도록 하는 것이 가장 중요한 지향점이 될 것이다. 국민기초생활보장법상의 재산환산 기준에서 제외시켜 줌으로써 장애인이 국민기초생활보장법, 장애인연금법상의 공공부조를 받을 수 있는 가능성을 열어 주어야 한다. 특별수요신탁의 도입을 위해서는 신탁의 법기술을 최대한 활용하되 현행 신탁법의 여러 원칙에 대한 예외가 인정되어야 할 것이다. 공공부조의 자산평가기준에 대한 예외와 신탁법 규정의 예외를 정하는 국민기초생활보장법상의 개정과 상속세 및 증여세법의 일부 개정이 필요하다. 또한 집합특별수요신탁을 위하여는 현행 신탁법과 충돌될 수 있는 여러 규정들과의 관계 정립, 수탁기관의 자격 정립, 수탁기관에 대한 정부의 재정지원 등이 필요한데, 이를 위하여 특별법의 제정이 필수적일 것이다.

영어초록

People with disabilities, especially those with severe disabilities, have no enough sources of income to lead a daily life compared with people with no disabilities in many cases. There are diverse income security plans for the disabled including the disability pension of National Pensions, the pension for the disabled in the Pension Act for the Disabled, and the allowance systems in Act on Welfare for the Disabled, but they offer no enough amounts and have limitations with meeting the various individual needs of the disabled. A trust system can be taken into consideration as a system to enable so-called custom service based on the individual needs of the disabled.
One of those options may be the introduction of Special Needs Trust(SNT) for trusters with disabilities in the United States. In case of SNT, the property raised to fund the Trust is not included in the review of eligibility qualification of public aid, which prevents any hindrance to the access of the disabled to the public aid benefits after a trust is set up. Collective SNT is especially a very useful system for the families of people with disabilities that belong to the low income bracket in the middle class and can afford to leave only the property of 100~200 million won.
In South Korea, the most important intention point will be the exclusion of trust funds raised to meet the special needs of the disabled from the property list in the National Basic Livelihood Security Act. When such funds are excluded from the criteria of property conversion in the National Basic Livelihood Security Act, there are open possibilities of the disabled benefiting from the public aid prescribed in the National Basic Livelihood Security Act and Pension Act for the Disabled. It is critical to make the best use of legal techniques of trust and recognize exceptions for the many principles of the current Trust Act in order to introduce SNT. It is needed to revise the National Basic Livelihood Security Act to establish exceptions for the property assessment criteria of public aid and the provisions of Trust Act and also the Act on Inheritance and Gift Taxes partially. The introduction of collective SNT demands the arrangement of relations between the current Trust Act and many potentially conflicting regulations with the Act, the establishment of qualification of trusteeship agencies, and the government's financial supports for trusteeship agencies, which makes it essential to enact a special act.
