통합적 장애인 인권지표 개발에 관한 연구 (A Study on the Development of the Integrative Human Rights Indicators for Persons with Disabilities)

초록

장애문제는 곧 인권문제이고, 따라서 인권관점의 책임 있는 논의와 인권정책의 체계적인 강구가 장애문제 해결의 핵심이라 하겠다. 이에 본 연구는 장애인 인권정책의 한 유형이자 요소로서 의미를 가지는 장애인 인권지표를 다차원적 측면을 고려하여 개발함으로써 장애인 인권보장의 사회적 책임을 보다 체계화하고 제반정책을 보다 정교화하는 데 기여하고자 하였다. 이를 위해 일반적 척도개발과 개입연구(D&D모형)의 과정을 참고하고 권리성과 지표구분의 논리성을 고려하여 지표안을 체계적으로 개발·검증하고자 하였는바 지표안 개발을 위해서는 이론분석, 법제분석, 사례분석 등을 적용하여 지표안의 구성과 내용의 기틀을 결정하는 데 참고하였고, 지표안 검증을 위해서는 전문가 평정에 의한 이론적 타당성 검증과 실제적 현실가능성 검증을 통해 인권요소의 충분한 반영과 인권실태의 적절한 적용을 확인하였다. 이러한 과정을 통해 최종적으로 다차원적 측면이 포함된 통합적 장애인 인권지표로서 개인지표, 환경지표, 성과지표 등 세 개의 지표를 개발하였다. 이러한 지표들은 공통적으로 실체적 권리관련 21개 항목(공통요소 19개 항목과 추가요소 2개 항목)과 절차적 권리관련 2개 항목 등을 포함하여 총 23개 항목으로 설정하여 구성하되 개인지표의 경우 평가대상의 구분적용에 따라(재가장애인용과 시설장애인용) 환경지표의 경우 접근권과 물리적 환경 간 중첩조정에 따라 약간의 항목변경을 유연하게 적용하여 실용성의 목적달성에 부합되도록 하였다. 본 연구에서 개발한 지표가 다양한 인권상황을 모두 포괄하여 적용가능하기에는 일정부분 한계가 있으나, 활용공간 및 시점별 변화가능성을 전제로(국가 및 지자체 혹은 시기별 시의적 인권이슈) 하나의 기반이자 규준으로서 가치와 의미가 상당히 있다고 사료되는 만큼 향후 활발한 활용과 논의가 있기를 기대해 본다.

영어초록

The disability issue is a human rights issue, and therefore, a responsible discussion of the human rights perspective and systematic development of human rights policies are the core of solving the disability problem, The purpose of this study was to develop a human rights indicators for persons with disabilities, which has meaning as a type and element of the human rights policy for persons with disabilities, to further systematize the social responsibility of human rights protection for persons with disabilities and to contribute to more elaborate policies. Therefore, I tried to develop and verify the indicators draft systematically by referring to the process of general scale development and intervention study(D&D model), and considering the logic of rights and indicators classification. I applied the theoretical analysis, legal analysis, case analysis, etc. for the development of the indicators draft to determine the framework of the structure and contents of the indicators draft. For the verification of the indicators, I tried to ensure sufficient reflection of human rights factors and appropriate application of human rights conditions by applying theoretical validity verification and practical feasibility verification by expert evaluation. Through this process, three dimensions of indicators were finally developed as the integrative human rights indicators for persons with disabilities: individual indicators, environmental indicators, and performance indicators. In common, these indicators are composed of a total of 23 items, including 21 items related to tangible rights (19 items in common elements and 2 items in additional elements) and 2 items related to procedural rights. In the case of environmental indicators according to the classification and application of the evaluation targets(for those with disabilities at home and those with disabilities in facilities), some item changes were flexibly applied according to the overlapping adjustment between the access right and the physical environment to meet the purpose of practicality. Although the indicators developed in this study are limited in some parts to be applicable to cover all various human rights situations, it is a basis and norm on the premise of the possibility of change by space and time of use(national and local governments or timely human rights issues). As it is thought that they have considerable value and meaning, I look forward to active use and discussion in the future.
