정신적 장애인에 대한 투표보조인 제도 (Voting Assistant System for Mentally disabled People)

초록

현행법상 모든 정신적 장애인은 장애의 정도를 불문하고 선거권을 부여받게 되었다. 그러나 그간의 연구에서 정신적 장애인에 대한 투표보조인에 의한 조력 제공이라는 주제는 다소 소홀하게 다루어졌던 감이 있다. 이에 본 논문은 최근 현실에서 문제된 바 있는 정신적 장애인에 대한 투표보조인 제도의 도입 가능성을 검토하여 보았다.
현행 공직선거법은 신체장애나 시각장애의 경우와는 달리 정신적 장애인에 대하여 투표보조인의 조력을 금지한다. 이러한 입법의 목적은 선거의 공정성 확보를 위한 것으로 이해된다. 그러나 현재의 투표보조인 관련조항은 정신적 장애인의 선거권을 침해한다고 할 수 있다. 무엇보다도 투표보조인 관련조항은 침해의 최소성 원칙을 위반한다. 투표보조인의 선정절차의 보완과 같은 기본권의 제약이 보다 적은 수단의 선택으로도 선거의 공정성을 도모하는 것이 가능할 것이기 때문이다.
이에 본 논문은 정신적 장애인에게 실질적인 선거권의 행사를 보장하면서, 선거의 공정성이라는 공익상의 요구를 함께 아우를 수 있는 대안을 모색하고자 하였다. 현재 국회에서 논의 중인 공직선거법 개정안은 정신적 장애인의 기본권 행사의 실효성을 담보하기 위한 진일보한 내용을 담고 있다. 그러나 동 개정안은 외국의 입법례에 비춰보면 다음의 점에서 개선의 여지가 있다고 보았다. 동 개정안은 정신적 장애인에게 투표보조인의 조력을 받기 위하여 ‘장애를 이유로 기표가 현저히 곤란할 것’이라는 요건을 갖출 것을 요구한다. 그런데 이러한 규정은 정신적 장애인에 대한 조력의 허용여부를 장애인 본인의 신청이 아닌 제3자의 재량에 맡기게 된다는 점에서 개선의 필요성이 있는 것이다. 나아가 동 개정안은 여전히 이른바 가족이 아닌 투표보조인에 한하여 그 숫자를 2인으로 둘 것을 강제하는데, 이는 장애인의 비밀선거권을 침해할 우려가 있다. 이에 본 논문은 별다른 제약 없이 장애인의 신청만으로도 장애인이 선택한 투표보조인의 조력을 제공받을 수 있는 제도의 개선이 필요하다고 보았다.

영어초록

Under the current law, all mentally handicapped persons were entitled to vote regardless of the degree of disability. However, in previous studies, the topic of providing assistance by voting assistants for the mentally handicapped was neglected. Therefore, this paper examines the possibility of introducing a voting assistant system for the mentally handicapped that is recently requested in reality.
The current Public Official Election Act prohibits the assistance of a voting assistant for the mentally handicapped, unlike the case of the physically or visually impaired. It is understood that the purpose of this legislation is to ensure fairness in elections. However, it can be said that the current provision of voting assistants infringes on the voting rights of people with mental disabilities. Above all else, the provision of voting assistants violates the principle of the least amount of infringement. This is because it will be possible to promote the fairness of the election even by selecting a means that has fewer restrictions on basic rights, such as supplementation of the selection procedure for voting assistants.
Therefore, this thesis tried to find alternatives that could cover the public interest demands of fairness of elections while guaranteeing the practical exercise of the right to vote for the mentally handicapped. The amendment to the Public Official Election Act, which is currently under discussion in the National Assembly, contains advanced content to ensure the effectiveness of exercising the basic rights of the mentally disabled. However, it was considered that the amendment had room for improvement in the following respects in light of foreign legislative practices. The amendment requires that persons with mental disabilities meet the requirement that ‘it will be remarkably difficult to vote due to disability’ in order to receive the assistance of a voting assistant. However, there is a need for improvement in these regulations in that it is left to the discretion of a third party, rather than the person with a disability, whether or not to allow assistance for the mentally disabled. Furthermore, the amendment still compels the number of voting assistants, not family members, to be set to two, which is considered to infringe the rights of persons with disabilities to vote in secret.
As a conclusion, it will be necessary to continuously seek a system in which the disabled can receive the assistance of the voting assistant chosen by the disabled without any particular restrictions.
