현행 헌법에 따른 외국인의 법적 지위- 외국인의 기본권 주체성에 관한 헌법재판소 결정을 중심으로 - (The Legal Status of Aliens in Korean Constitution - Focus on the Decision of the Constitution Court on Aliens -)

초록

헌법재판소는 그동안 외국인이 청구한 헌법소원심판을 심사할 때 외국인의 기본권 주체성을 인정하여 헌법소원심판청구를 받아들였다. 그러나 이 과정에서 헌법재판소는 외국인이 우리 헌법상 기본권 주체성이 있는지 헌법적인 근거를 제시하지 않았다. 외국인의 기본권 주체성의 문제가 주된 쟁점이 아니었던 선례에서 국민과 유사한 지위에 있는 외국인에게 기본권 주체성을 인정한 사례를 근거로 헌법재판소는 일반적으로 외국인에게 기본권 주체성을 인정하고 또 헌법적 근거 없이 기본권 가운데 인간의 권리로서 성격을 가지는 기본권은 외국인에게도 보장된다고 한다. 그러나 우리 헌법은 제2장에서 기본권 보장대상으로 국민을 명시하고 또 헌법제정과정에서도 헌법제정권자는 외국인을 기본권 보장대상에서 배제하였음으로 외국인은 기본권 주체성을 가지지 못한다.
우리 헌법은 외국인의 법적 지위를 제6조 제2항에서 규정한다. 이에 따르면 외국인은 국제법과 조약에 의하여 그 지위가 보장된다. 따라서 외국인이 헌법재판을 청구할 수 있는지 그리고 기본권 주체성이 인정되는지 여부는 이 조항에 따라 결정되어야 한다. 그러나 외국인에게 기본권 주체성을 인정하는 국제법은 없다. 또 우리가 체결한 조약 가운데 시민적 및 정치적 권리에 관한 국제규약(B규약) 제14조도 외국인에게 재판청구권을 보장하지만 이때 보장되는 재판은 민사재판과 형사재판뿐이다. 따라서 헌법재판을 받을 권리는 외국인에게 보장되지 않는다. 따라서 외국인에게 기본권 주체성을 인정한 헌법재판소의 결정은 헌법 제6조 제2항을 오해한 결정으로 헌법적으로 정당화될 수 없다.

영어초록

The Constitutional Court has recognized aliens as the subjectivity of fundamental rights in Korean Constitution when examining a petition relating to the Constitution requested by an alien, and accepted his application of a petitions relating to the constitution. In the process, however, the Constitutional Court did not propose any constitutional basis for the reason why aliens have the subjectivity of fundamental rights under the Constitution. On the basis of the precedent in which the issue of the subjectivity of the basic rights of aliens was not the main issue and the Court only approved the subjectivity of the confined aliens with similar status to a citizen, therefore the Constitutional Court did not demonstrate the reasons in detail, the Constitutional Court generally recognized the subjectivity of the basic human rights written in chapter Ⅱ of the Constitution to aliens. However, because on the one hand the word “nation” with meaning of Korean Nationality is evinced in chapter Ⅱ of the Constitution, and because on the other hand the Constitution Enactor excluded aliens from the Guarantee of the basic fundamental rights, the basic human rights in the Constitution is not guaranteed to aliens.
Our Constitution provides for the legal status of aliens in Article 6 (2). According to this, the status of aliens is guaranteed as prescribed by international law and treaties. Therefore, whether an alien can file a petition relating to the Constitution and whether the subjectivity of the basic rights of aliens is recognized should be decided in accordance with this paragraph. However, there is no international law recognizing the fundamental rights of aliens. In addition, Article 14 of the International Covenant on Civil and Political Rights (B of the Covenant) also guarantees the right of trial to all persons, but only the civil and criminal trials are guaranteed at this time. Therefore, the right of Petitions to the Constitution Court is not guaranteed to aliens. Therefore, the decision of the Constitution Court recognizing the subjectivity of the fundamental rights to aliens was made on the basis of misunderstanding of Article 6 (2) of the Constitution. Therefore, the decision can not be constitutionally justified.
