충청남도 장애인 평생교육 지원조례 분석 (Analysis of Chungcheongnam-do Ordinance on Support for Lifelong Education for the Disabled)

초록

본 연구는 충청남도의 5개 지방자치단체에서 제정된 장애인 평생교육 지원 조례를 규범적 타당성, 규범적 실효성, 거버넌스 실현의 세 가지 차원에서 내용분석 방법으로 특징을 파악하고, 이를통해 충청남도의 지역 중심 장애인 평생학습 기반 구축의 방향성을 제안하고자 하였다.
연구결과, 첫째, 충청남도 광역지자체와 기초자치단체의 장애인 평생교육 지원 조례들의 구성 및 내용이 지역의 특수성을 반영하지 못하고 있다. 둘째, 규범적 타당성에서 자치단체장의 책무가 모호하며, ‘예산의 범위에서 지원할 수 있음’을 명시하여 적극적인 정책으로 보기 어려워 효율성이 매우낮다고 할 수 있다. 셋째, 규범적 실효성에는 장애인 평생교육을 전담하는 기관이나 관련 협의체 관련 조항이 미흡하였고, 장애인 평생교육 종사자에 대한 명확한 규정도 없었고, 전문성을 향상하거나역량을 개발할 수 있는 조항을 찾아보기 어려웠다. 넷째, 거버넌스 실현은 장애인 평생교육 참여를활성화하기 위한 홍보와 편의 제공 조항을 찾아보기 어려웠다. 장애인 평생교육 기반 구축을 위한제언으로는 첫째, 충남지역의 15개 기초지자체 중 4개 지역만이 조례를 시행하고 있으므로, 지자체의 특수성을 반영한 장애인 평생교육 조례 제정이 시급하다. 둘째, 지역에 기반한 평생교육 체제 확립과 장애인 평생교육 전담기관과 전문인력이 필요하다. 셋째, 장애인 평생교육 정책의 지속성 확보를 위해 조례에 예산과 재정 책임성을 명시해야 한다.

영어초록

This study aims to analyze the characteristics of the ordinances supporting lifelongeducation for individuals with disabilities established by five local governments inChungcheongnam-do through content analysis, focusing on three dimensions: normativevalidity, normative effectiveness, and governance realization. Based on this analysis, the studyseeks to propose directions for establishing a community-centered lifelong learning frameworkfor individuals with disabilities in Chungcheongnam-do.
The findings of the study are as follows: First, the composition and content of the ordinancessupporting lifelong education for individuals with disabilities in both the metropolitan andbasic local governments of Chungcheongnam-do do not adequately reflect the region's specificcharacteristics. Second, regarding normative validity, the responsibilities of local governmentheads are ambiguous, and the stipulation that support can be provided “within the budgetarylimits” makes it difficult to view these policies as proactive, resulting in very low efficiency.
Third, in terms of normative effectiveness, there are insufficient provisions related toinstitutions dedicated to lifelong education for individuals with disabilities or relevantconsultative bodies, and there are no clear regulations regarding personnel involved in lifelongeducation for individuals with disabilities. Additionally, it is challenging to find provisionsaimed at enhancing expertise or developing competencies. Fourth, there is a lack of provisionsfor promoting participation in lifelong education for individuals with disabilities and forproviding necessary conveniences to facilitate this participation.
As recommendations for establishing a foundation for lifelong education for individuals withdisabilities, first, since only four out of the 15 basic local governments in Chungnam arecurrently implementing ordinances, it is urgent to establish ordinances that reflect the specificcharacteristics of local governments. Second, there is a need to establish a community-basedlifelong education system and dedicated institutions and professionals for lifelong educationfor individuals with disabilities. Third, to ensure the sustainability of policies for lifelongeducation for individuals with disabilities, it is essential to specify budgetary and financialaccountability in the ordinances.
