초록

유엔장애인권리협약 제19조는 오랫동안 소외되고 차별받아 왔던 장애인이 지역사회로 나와 다른 사람과 동등하게 자립생활을 할 권리가 있음을 규정한 의미 깊은 조항이라고 할 것이다. 그러나 유엔장애인권리협약 제19조의 “자립생활과 지역사회에의 참여” 규정에 근거하여 모든 시설 장애인을 탈시설시켜야 한다는 것은 유엔장애인권리위원회의 치우친 해석일 뿐, 사회통념상 합리성이 없다. 헌법의 규정이 그러하듯 유엔장애인권리협약 제19조는 선언적 성격을 띠고 있는 규정으로 보아야 한다. 즉, 당사국은 장애인의 자립생활과 지역사회에의 참여를 위해 노력을 할 의무가 있고, 개별 장애인이 처한 사정을 고려하여 자립이 가능한 장애인에게는 자립을 지원하고, 자립이 불가능한 장애인에게는 그에게 적합한 지원을 해 주도록 하는 것이 이 조항에 대한 논리적 해석이라고 할 것이다.
이제 세계적으로도 탈시설은 비판의 대상, 비현실적인 이상으로 변해가고 있다. 탈시설이 자립할 능력이 없는 중증발달장애인을 방치함으로써 지역사회에서의 자립생활은 커녕 이들을 오히려 더 격리시키고 최악의 경우 사지로 내몰고 있기 때문이다. 따라서 입법자는 발달장애인의 현실에 맞지 않는 탈시설법안을 즉각적으로 폐기해야 한다. 또한 인권침해행위가 발생한 경우 시설을 폐쇄하도록 한 현행법의 독소조항을 즉시 삭제해야 한다.
이제라도 국가는 탈시설에 들어갈 천문학적 비용을 장애 유형과 정도에 맞는 신규 거주시설 설치로 전환시켜 수천명 입소 대기자들의 염원을 실현시켜 주어야 한다. 그것만이 잠재적 동반자살자가 될 중증발달장애인들과 그 가족이 살 길이다.

영어초록

Article 19 of the United Nations Convention on the Rights of Persons with Disabilities(CRPD) is a significant provision that stipulates that persons with disabilities, who have long been marginalized and discriminated, have the right to come out of their communities and live independently without interference from others. However, it is only a biased interpretation of the UN Committee on the Rights of Persons with Disabilities that all facilities with disabilities should be deinstitutionalised based on Article 19 of CRPD. Article 19 of CRPD should be viewed as a declarative provision, as is the constitution’s provision. In other words, the state parties are obligated to make efforts to ensure the independent living of persons with disabilities and to participate in the community, and it would be a logical interpretation of this provision to provide self-reliance support to persons with disabilities who are able to stand on their own feet in consideration of the circumstances in which individual persons with disabilities face, and to provide appropriate support to persons with disabilities who cannot stand on their own feet.
Now, even globally, deinstitutionalisation is turning into objects of criticism and unrealistic ideals. This is because deinstitutionalisation neglect people with severe developmental disabilities who are unable to become self-reliant, rather than living independently in local communities, and in the worst case, they are being driven to death. Therefore, the state and local governments must immediately abolish deinstitutionalisation policies that do not fit the reality of people with developmental disabilities. In addition, the toxic clause of the current law that requires the facility to be closed in the event of human rights violations should be immediately deleted.
Even now, legislators must convert the astronomical costs of deinstitutionalisation into the installation of new residential facilities suitable for the type and degree of disability to realize the wishes of thousands of people waiting for admission. That is the only way for people with severe developmental disabilities and their families who will become potential co-suicidal people to live.
