초록

장애인의 인권문제는 우리사회뿐만 아니라 국제사회에서 관심을 모으고 있는 인권 문제 중 하나이다. 장애인은 비장애인과 동등한 위치에서 인간으로서 누려야 할 기본적 권리와 자유 또한 많은 부분에서 제한당하는 차별을 받아 왔다. 이러한 열악한 상황에 처에 있는 장애인의 인권을 증진시키기 위해서 장애인권 단체와 인권운동가들은 장애인에 대한 관심을 제고시키고 장애인에 대한 인식 개선을 위해 투쟁하였으며 그 헌신적인 노력에 국제사회는 마침내 장애인의 권리장전이라 불리우는 ‘장애인권리협약’으로 부응하였다.
우리나라는 장애인권리협약이 2009년 1월 10일 국내에서 발효된 후 2011년 제1차 국가보고서를 작성하여 유엔 장애인권리위원회에 제출하였고, 유엔 장애인권리위원회는 2014년 9월 17일과 18일에 대한민국 제1차 국가보고서를 심의하고 심의 후 9월 30일에 주요 우려사항과 권고를 담은 최종 견해를 채택하고 이를 10월 3일에 발표한 바 있다. 장애인권리위원회는 장애등급판정제도 개선, 협약 선택의정서 채택, 장애인차별금지법상 구제조치의 실효성 보장을 위한 법관들의 인식제고, 성년후견제의 대체의사결정에서 조력의사결정으로의 전환, 활동지원서비스 확대, 효과적인 탈시설화 전략수립 등 협약 27개 조문에 대해 권고했으며 장애인권리협약의 이행노력을 촉구한 바 있다.
이런 상황에서 본 논문은 유엔 장애인권리위원회가 권고한 내용 중에 특히 ‘장애인차별금지 및 권리구제 등에 관한 법률’(이하 ’장애인차별금지법‘이라 한다.)의 효과적 이행을 위한 법원의 권리구제 조치와 법무부 장관의 시정명령과 관련된 법제도상의 개선 방향을 살펴보고, 그 전제로 이와 관련한 장애인차별금지법상의 문제점과 한계 등을 검토하고자 한다.

영어초록

The human rights problem of persons with disabilities is one of the human rights problems grabbing the attention of, not only the Korean society but, the international community. Persons with disabilities suffered discrimination in basic rights and freedom, to be enjoyed by people, on the equal status as people without disabilities, as well as being restricted in many aspects. In order to improve the human rights of persons with disabilities, facing many difficulties, the human rights organizations for persons with disabilities and human rights activists have fought to raise the awareness on the persons with disabilities and to improve the perceptions of the persons with disabilities. As the results of their devotional efforts, the international community finally answered with the Convention on the Rights of Persons with Disabilities, which is known as the bill of rights of persons with disabilities.
Korea has completed the initial report in 2011 and submitted to the UN Committee on the Rights of Persons with Disabilities. The Committee on the Rights of Persons with Disabilities considered Korea's initial report on September 17th and 19th of 2014, adopted the concluding observation, which included major concerns and recommendations, on September 30, and announced it on October 3. The Committee on the Rights of Persons with Disabilities made recommendations on 27 provisions of the Convention, including improving the disability determination and rating system, ratifying the optional protocol of the Convention, raising awareness among judges on the need to implement effectively the Anti-Discrimination against and remedies for Persons with Disabilities Act(ARPDA), moving from substitute decision-making to supported decision-making, significantly increase of support services in the community, developing effective deinstitutionalization strategies, etc., and urged efforts to implement the Convention on the Rights of Persons with Disabilities.
With this as the background, this study intends to examine the remedy of rights by the court for the efficient implementation of the Anti-Discrimination against and remedies for Persons with Disabilities Act(ARPDA), Remedy Against Infringement of Their Rights, Etc. (hereinafter referred to as “the Anti-Discrimination against and remedies for Persons with Disabilities Act”) and direction of improvement for the legal system related to the remedial order of the Minister of Justice, among the items recommended by the UN Committee on the Rights of Persons with Disabilities, and as a prerequisite, this study intends to review the problems and limitations, etc. of the Anti-Discrimination against and remedies for Persons with Disabilities Act(ARPDA).
