북한의 장애인 관련 법제와 실태 — 북한의 ‘유엔 장애인권리협약 이행 최초보고서’를 중심으로 — (A Study on the situation of Persons with Disabilities and Related Laws of North Korea — Focusing on the Initial report to CRPD submitted by North Korea —)

초록

북한은 2000년대 이후 사회복지 분야에서 법제화를 추진해왔으며, 특히 장애인 권리와 관련하여 2003년 6월 18일 장애자보호법을 제정하고 2013년 7월 3일 유엔장애인권리협약에 서명하고 2016년 11월 23일 이를 비준하는 등 국제사회의 지적에 적극적으로 호응하여 법과 제도를 개선하고 있다. 나아가 북한은 2018년 12월 19일 유엔장애인권리협약에 따라 최초로 유엔장애인권리위원회에 장애인 인권 실태에 관한 국가보고서를 제출하였다.
북한이 제출한 국가보고서는 유엔장애인권리협약의 조문 체계 순서에 따라 보고서가 작성되어 있으며 북한 국내법 중 장애인과 관련된 법령에 대한 소개와 같은 추상적, 일반적 진술이 대부분을 차지하고 있다. 다만, 일부 항목에 있어서는 최근 북한 당국이 중점을 두고 있는 장애인 정책의 개선 사항 및 문제점 및 장애인 관련 통계를 소개하고 있다. 정확성과 신뢰성의 측면에서의 한계에 대한 비판이 있을 수도 있겠지만 북한이 최초로 자국의 장애인 실태에 대하여 공식적으로 국제사회에 공개하는 보고서라는 점에서 분석의 의의가 크다고 볼 수 있다. 국가보고서의 내용을 검토해볼 때 아직 객관적으로 보면 부족하다고 볼 수도 있으나 다른 분야의 국제사회의 인권에 대한 문제제기에 대한 북한 당국의 기존 반응과 비교할 때 적어도 장애인 인권 분야에서는 큰 변화라고 평가할 수 있다. 특히 북한 당국이 국가보고서에서 유엔장애인권리협약 비준 후의 후속조치로서 장애자보호법의 명칭을 장애자권리보호법으로 개정하는 문제 등 장애인의 권리 확대 사안을 검토 중에 있다고 명문으로 밝힌 것 역시 긍정적인 신호라고 볼 수 있다.
이렇게 북한이 국가보고서를 통해 제도개선에 대한 수용의사를 밝힌 만큼 우리 역시 국제사회와 함께 준비할 필요가 있다. 상대적으로 비정치적인 분야이며 남북교류협력 과정에서도 남북한 상호간 및 남북한 내부에서 갈등 소지가 적은 분야라는 점에서, 북한 장애인법제에 대한 관심은 매우 중요하다고 할 것이다. 특히 향후 남북 간에 인도적 지원이나 경제적 관점에서의 교류 차원을 넘어 법제 분야에서의 교류협력을 대비한다는 측면에서 생각할 때 장애인법제 분야는 가장 실현 가능성이 높은 분야라고도 볼 수 있다. 따라서 북한 장애인법제의 동향 및 법제 개선을 돕기 위한 우리의 역할에 대한 지속적인 관심과 연구가 더욱 필요하다.

영어초록

Since 2000, North Korea have been pushing for legislation in the field of social welfare and adopted the Law on the Protection of Persons with Disabilities on June 18, 2003 and signed the Convention on the Rights of Persons with Disabilities(hereafter Convention) on July 3, 2013 and ratified it on November 23, 2016. North Korea actively responded to criticism on the rights of the persons with disabilities from the international community and improved laws and institutions of that field. Furthermore, on December 19, 2018, North Korea submitted its Initial Report on the Implementation of the Convention on the Rights of Persons with Disabilities(hereafter Initial Report) to the UN Committee on the Rights of Persons with Disabilities.
The Initial Report is reported in the order of the Convention. Although the most portion of the Initial Report concluded abstract and general statements, such as the introduction of laws and regulations related to persons with disabilities, however, in some items, the North Korean authorities have been introducing the improvement of the policy and the statistics related to persons with disabilities.
Although there may be criticism in terms of accuracy and reliability, the Initial report is meaningful in that it is the first report that North Korea officially discloses to the international community about the situation of its persons with disabilities. When reviewing the contents of the Initial Report, it may be said that the content is still insufficient. However, compared with the North Korean authorities' response to the issue of human rights in other fields, it should be considered big progress. In particular, it is also a positive sign that North Korea is reviewing the issue of expanding the rights of persons with disabilities and the revision of the existing Law on the Protection of Persons with Disabilities to be retitled as the Law on the Protection of the Rights of Persons with Disabilities with a view to further incorporation of the requirements of the Convention. Because it is a non-political human rights issue and there is little room for political conflicts, the Law on the Protection of Persons with Disabilities is very important. In particular, there is a need to prepare for exchanges and cooperation between the North and South Korea in the field of law, the law regarding persons with disabilities is the most feasible field in that cooperation. Therefore, there is a need for continued interest and research on the trends in the legislation related to the persons with disabilities in North Korea and our role in improving the legal system of North Korea in that field.
