피의자신문에 참여한 변호인의 진술거부권행사 권고와 변호인윤리 (Lawyer's Advice regarding the Exercise of the Right to Remain Silent during Interrogations and Lawyer's Professional Ethics)

초록

본 논문은 우리나라 형사소송법제에서 변호인의 피의자신문참여권이 갖고 있는 의의와 법적 성질, 그 내용에 대해서 검토하였다. 특히 피의자신문에 참여한 변호인이 진술거부권행사를 권고할 수 있는지 여부 및 그 한도에 대해서 변호인윤리와 관련하여 살펴보았다. 피의자신문제도의 성격과 피의자신문에 참여한 피의자의 수인의무 유무는 소송구조에 따라 달라질 수 있지만, 변호인의 피의자신문에의 참여권은 소송구조나 수인의무유무와 상관없이 우리나라 고유의 법제도 및 법문화에 의거해서 인정될 수 있으며, 특히 헌법상 보장된 변호인의 접견교통권의 내용과 본질적으로 동일하며, 입법자의 입법이 없이도 그 권리행사가 가능한 자유권적 기본권이자 경우에 따라서는 청구권적 기본권의 성격도 갖는다. 따라서 그 제한에 있어 과잉금지입법원칙과 위임입법금지원칙이 적용될 터인데, 현행법상 변호인의 피의자신문참여권의 제한규범은 규율 형식적인 면에서나 규율 내용적인 면에서 적절치 못하며 따라서 입법론적 개선이 필요함을 주장하였다. 즉 피의자신문참여제한 사유들을 형사소송법에 보다 구체적이고 명확하게 규율할 필요성이 있으며, ‘진술번복 또는 특정답변의 유도’ 등 현재 인정되고 있는 수사방해의 유형들도 경우에 따라서는 변호인조력권의 본질적 내용에 부합하는 합법적 변호행위가 될 수 있으므로 그 적절성에 대한 재검토 및 수정이 필요하다는 것이다. 특히 진술거부권 권고권한을 포함하여 형사절차에 참여한 변호인이 지켜야 할 윤리 및 권한에 대해서 변호인윤리에 관한 실정규범에 명문화할 필요가 있다.

영어초록

Currently, a prosecutor in Korea officially submitted to the Korean Bar Association an application for commencement of disciplinary action against seven lawyers. One of the grounds for this application was whether the lawyers forced or just advised their clients to plead the right to remain silent for their best interest during interrogations, and whether such conduct violated the provisions of professional ethics that prohibits lawyers from damaging their dignity as attorneys and duty of candor to the tribunal. Around the same time, the Korea National Policy Agency announced that it would not accept the recommendations by National Human Rights Commission of Korea to take measures not to interfere with the exercise of the right to assembly during the police interrogation. These two affairs reveal the conflicts existent between investigation agencies and the lawyers participating in suspect interrogations and the need for resolving the conflicts through reasonable interpretation of the current rule on this issue and its reform, when necessary.
Accordingly, this article reviews the right for the counsel to participate in suspect interrogations and its legal limitations, which was founded by the 2007 criminal procedure reform. This paper concludes that the right for the counsel to participate in suspect interrogations should be qualified as a fundamental right guaranteed by the Korean constitution, and its limitations should be justified only by the Act of Congress, not by the current administrative ordinance. Any restriction on this right for reasons of ‘interrogation disturbance’ should be also justified using objective and reasonable criteria. In particular, lawyers' advice on the right to remain silent during interrogations should not be regarded as a ‘justifiable’ criteria for restricting the counsel's right of participation in suspect interrogations or as a violation of professional ethics provisions, but rather should be prescribed as their duty for their client's best interest and for criminal justice in professional ethics.
