언론중재 제도의 조정전치 기능에 대한 재고찰: 소송에 갈음하는 분쟁해결방안(ADR)의 효율성 관점에서 (A Critical Review of the Current Discussion About Strengthening the Conciliation Function of the Press Arbitration Commission)

이 논문은 언론피해구제제도의 실효성 제고 방안을 검토하기 위한 연구이다. 한국의 독특한 제도인 언론중재제도는 언론자유를 침해할 수 있다는 비판을 받기도 하였으나 지난 23년 동안의 중재처리실적과 세 차례 실시된 이용자만족도 조사결과를 종합 분석한 결과, 조정의 양과 질 면에서 아직 기대에 미치지는 못하지만 언론피해구제장치로서 유용한 제도로 나타났다. 언론중재제도 실효성 제고 논의의 핵심은 조정전치의 범주와 조정의 기속력을 어떻게 설정할 것인지의 문제로 집약되는데 현재 반론보도청구권만 필요적 조정전치대상으로 하고 있는 것을 정정보도청구권 및 손해배상청구권까지로 넓혀 언론피해구제에 관하여 원스톱 서비스를 하는 것이 바람직하다고 본다. 아울러 당사자가 이의신청을 하는 경우 별도의 신청절차를 거치지 않더라고 자동적으로 소가 제기된 것으로 간주하는 것도 한 가지 방법이다. 다만, 이러한 방안은 언론피해구제의 실효성 제고라는 단선적 차원에서만 살필 것이 아니라 헌법이 보호하고 있는 또 다른 기본권과의 충돌여부 등 법리적 판단, 중재위원회의 현실적 수용여건 등을 종합적으로 고려해야 새 제도의 착근이 가능하므로 단계별 도입으로 부작용을 최소화하는 것이 필요하다.

영어초록

This study examines current discussions on the ways to enhance the efficacy of the damage relief system stemming from cases involving erroneous press reports. Korea's unique press arbitration system has been given both positive and negative evaluation. While the positive view claims that it is an efficient and speedy alternative dispute resolution (ADR) system, the negative view blames that it only delays formal court proceedings. When the press arbitration system was first introduced in 1981, some people including journalists criticized it could result in the infringement of press freedom. Recently researchers have compiled and analyzed decisions of the Press Arbitration Commission (PAC) made over the past 23 years. On three occasions, PAC also surveyed the level of satisfaction of the petitioners and respondents. The results showed that both the quantity and quality of the decisions tended to fall short of the high expectations about the PAC. However, they demonstrated that the press arbitration system should be continued and further developed. For the last two decades, there have been various proposals for strengthening the efficacy of press arbitration system. They mainly concern determining the scope of the PAC conciliation action and defining the binding power of the PAC. Currently, the PAC conciliation action is mainly focussed on requests for a rebuttal. Based upon the analysis, it was found that the PAC authority should be expanded to include requests for correction of erroneous press reporting as well as for compensation for damages so that the Commission could offer one-stop relief service. Regarding the authority of the PAC, the Commission's binding power should be strengthened to the level of a district court. In this way, when any party does not accept the decisions of the PAC, the case would be allowed to move to an appeals court directly and automatically. Additionally, in order to minimize any possible adverse effects the measure may entail, the PAC may well be allowed to deal with requests for correction and compensation in addition to requests for rebuttal and the PAC may be empowered with the same authority as a district court. In so doing, however, it is needed to point out that the expanded scope of conciliation of the PAC should not chill the essential function of the press.
