가정폭력 문제음주자의 특성분석을 통한 치료사법체계의 개선방안에 관한 연구 (A Study on the Improvement Plan of the Treatment Judicial System though the Characteristics of Problem Drinkers Committing Domestic Violence)

초록

가정폭력은 지속적으로 반복되며 점점 심화되어 가족해체 등을 가져오는 심각한 사회문제이다. 특히 가정폭력은 과도한 음주로 인한 공격적 행위나 범죄행위를 더 많이 하는 것으로 보고되고 있다. 가정폭력의 문제는 가정 내의 문제만이 아니며 우리 사회가 함께 풀어야 할 숙제이다. 특히 가정폭력과 알코올 문제를 함께 갖고 있는 문제자들과 가족들이 처한 다양한 현실을 고려하면서 만성화된 가족병 해결에 적합한 장기적인 ‘지원과 관리’ 시스템이 필요하다. 보다 효과적이고 통합적인 치료사법 시스템을 위해서는 가정폭력과 음주문제를 복합적으로 가진 행위자들의 특성을 파악하는 것이 무엇보다 중요하다. 따라서 이 연구에서는 서울가정법원으로부터 의뢰된 가정폭력 문제음주자의 특성을 밝히고, 이를 통해 치료사법체계에 대한 변화의 근거를 마련하고자 정책적인 시사점을 제안하고자 하였다.
연구결과 가정폭력 문제음주자의 특성은 첫째, 낮은 자존감과 고정된 성역할 태도를 갖고 있다. 둘째, 일반적으로 가정폭력을 행하는 사람에 비해 폭력이 더 심각하다. 셋째, 폭력 전과를 갖고 있으며 자녀 세대까지 이어지는 폭력 순환의 특성을 띄고 있다.
향후 외국의‘약물법정’과 같은 법적인 제도화와 치료사법체계의 발전을 기대하며 이 연구결과를 토대로 치료사법체계 개선을 위한 방안을 다음과 같이 제안한다. 첫째, 치료에 대한 동기화를 촉진시키기 위해서는 강한 법적 강제력이 필요하다. 둘째, 가정폭력 문제음주자의 요구(needs)에 맞는 다양한 서비스가 필요하다. 셋째, 수탁명령(임시조치ㆍ보호처분)을 받은 행위자에 대한 평가를 위해 다학제적인 접근과 지역사회위원회를 구성하여 문제해결을 위한 다각적인 접근이 필요하다. 마지막으로, 피해자를 포함하여 가족 구성원 전체에 대한 치료가 동반되는 가족적 접근이 필요하다.
한편, 법원 수탁명령과 관련된 일산의 H 기관 내의 전담팀의 부재로 축적된 자료가 체계적이지 못하다는 연구의 한계가 있다. 이는 법원 수탁명령과 관련된 업무가 한시적이기도 하고, 제도적 장치가 미비하기 때문이라고 보아진다. 이러한 한계에도 불구하고 연구자들은 수집된 자료를 충실하게 분석하여 가정폭력 문제음주자의 특성을 밝혀내고자 노력하였다. 이러한 측면에서 이 연구는 서울가정법원에서 위탁된 문제음주자의 특성을 밝혀보는 기초 연구로써, 이후 문제음주자와 가족들을 위한 법적장치의 치료프로그램의 발전과 제도를 구축하고 법원 수탁명령 대상자를 위한 치료재활 프로그램 개발을 위한 기초자료로 유용하다고 생각한다.

영어초록

Domestic violence is serious, repeated continuously, and family breakdown is a serious social problem. Especially, Domestic violence caused by excessive drinking, aggressive behavior or criminal activity reported to be more. Domestic violence is not just a problem in the home, is a difficult challenge for our society together. In particular, domestic violence offenders with alcohol problems and their family facing various problems should be considered. And a long-term support and management system is required for chronic illness resolves. To understand characteristics of actors in combination with domestic violence and alcohol problem is more important for more effective and integrated justice system. Therefore, this study reveals the nature of domestic violence problem drinkers referred from Seoul Family Court. The purpose of this study is to suggest its policy implication in order to provide a basis for characteristics of domestic violence and problem drinkers to change in the treatment judicial system.
As a result, characteristics of problem drinkers committing domestic violence are as follows; first, they has low self-esteem and a fixed gender roles. Second, typically domestic violence is more serious violence than those who do. Third, they have a history of violence and the cycle of violence leading up to children's.
We look forward to the development of treatments judicial system and legal institutionalization such as 'drug court' in the future. To improve the domestic violence batterer treatment judicial system, this study suggests some political implication as follow. First, the strong legal force to promote treatment motivation is needed. Second, Multidisciplinary approach to problem solving is required. Third, the variety of services are required to meet the needs of problem drinkers committing domestic violence. Finally, there needs the family approach including victims and treatment of family members.
On the other hand, the limits of this study is that the accumulated data did not systematical. Because there is no Task Team that associated with the court order. It is temporary work and the system is insufficient. In spite of these limitations, the researchers were working to uncover the characteristics of problem drinkers committing domestic violence analyzing gathered data faithfully. This study is basic research about characteristics of problem drinkers committing domestic violence referred to by the Seoul Family Court the Family Court. In addition, starting from this study, it is considered usefully to establish legal systems for more active and systematic interventions that can develop in problems between problem drinkers committing domestic violence and their families.
