분양면적에 따른 아파트 주차장의 사용은 가능한가? - 집합건물법 제11조와 제17조의 해석을 중심으로 (Is it possible to use the parking lot of the apartment according to the area? - Focusing on the interpretation of Articles 11 and 17 of Korean Act on Ownership and Management of Condominium Buildings )

초록

한국의 주거형태는 아파트가 50%를 상회하고 있으며, 연립주택, 다세대주택 등 집합건물에 포섭될 수 있는 거주형태에 우리 국민의 대다수가 거주하고 있다. 2021년 말 기준으로 한국에 등록된 자동차는 2,491만 대로 2020년 말 대비 55만대가 증가하였고, 인구 2.07명당 1대의 자동차를 보유하고 있다. 이렇게 증가하는 자동차의 수는 아파트에 거주하는 입주민들에게 심각한 주차문제로 인한 갈등과 분쟁을 발생시키는 원인이 된다. 이를 해결하는 것은 결코 쉬운 일이 아닌데, 공간확보의 문제뿐만 아니라, 공간이 확보되더라도 공간의 사용과 부담 그리고 수익의 배분에 논쟁의 여지가 존재하기 때문이다. 집합건물의 공용부분은 구분소유자 전원의 공유에 속하는 것이고, 집합건물법 제11조에 따라 구분소유자들의 공용부분의 사용은 지분에 비례하는 사용이 아니라 그 용도에 따라 전면적으로 사용할 수 있다는 법원의 판단이 존재한다. 그러나 집합건물법 제17조에서 규율하고 있는 공용부분의 부담과 수익을 살펴보면 각 공유자는 규약에 달리 정한 바가 없으면 그 지분의 비율에 따라 공용부분의 관리비용과 그 밖의 의무를 부담하며 공용부분에서 생기는 이익을 취득한다고 규정하고 있다. 따라서 집합건물법 제11조를 해석함에 있어 구분소유자의 권리와 의무를 기반에 두어야 할 것이며, 규약의 설정, 변경, 폐지가 집합건물법 제29조 제1항에 따라 일부 구분소유자의 권리에 특별한 영향을 미칠 때에는 그 구분소유자의 승낙 역시 필요하다고 보아야 할 것이다.

영어초록

Apartments account for more than 50% of the housing type in Korea. The apartment is one of the housing type of condominium buildings that include such as tenement houses and multi-household houses. As the increasing of condominium buildings, parking problem is very common issue in Korea. There were 24.91 million cars registered and one car per 2.07 population on the end of 2021 in Korea. This is due to an increase of 550,000 vehicles compared to 2020. Residents living in apartments are experiencing serious parking problems due to the increase in automobiles, which causes conflicts and disputes among residents. It is not easy to solve the parking problem, because of not only the problem of securing space, but also problems related to the use and burden of space and distribution of profits even if the space is secured. According to articles 11 of Korean Act on Ownership and Management of Condominium Buildings (KAOM), each co-owner in condominium, who is resident and sectional owner at the same times, is entitled to use the section for common part in conformity with its purpose. Based on article 11 KAOM, a korean district court has judged that the use of the common part is not proportional to the share of the co-owner in condominium, but common part can be used by each co-owner entirely according to the purpose. According to articles 17 KAOM, each co-owner shall bear the management costs of the section for common use or other obligations, and gain profits accruing therefrom according to the ratio of his or her share, unless otherwise specified by the regulations. Presumably, in this case, the district court seems to have neglected the existence of article 17 KAOM. Therefore, it should be based on the rights and obligations of the sectional owner in solving the problems related to the parking lot of condominium. When the establishment, amendments, and repeal of management rule for condominium related to parking lots has a special effect on certain sectional owners’ rights, the consent of the sectional owners is also required.
