융복합 의료제품의 품목허가 지원을 위한 법제도 개선연구 -미국 융복합 의료제품 분류 및 유형을 중심으로- (A study on the improvement of the legal system to support Licensing of Combination products -Focusing on Classification and Types of U.S. Combination Products-)

초록

융복합 의료제품이란 의약품과 의료기기가 조합된 제품을 말한다. 프리필드 시린지나, 약물방출 하이드로겔 창상피복재가 여기에 해당하는 대표적인 제품군이다. 우리나라의 경우, 의료제품에 적용되는 법률은 의약품에 적용되는 「약사법」과 의료기기에 적용되는 「의료기기법」으로 양분되는데, 양법의 정의규정은 서로를 적용범위에서 배제시키는 상호배제적 규정방식을 취하고 있다. 그러나 융복합 의료제품은 의약품과 의료기기의 속성을 모두 가지고 있기 때문에 인허가 절차상 의약품이나 의료기기 어느 하나의 제품군으로 허가를 받기 어려운 실정이다. 이러한 문제를 해결하기 위하여 식품의약품안전처는 「융복합 의료제품 민원조정 및 처리절차에 관한 규정」이라는 예규를 만들어 융복합 의료제품 관련 정의나 분류기준을 담아 업무를 처리하고 있다. 그러나 해당 규정은 식약처의 업무처리 규정에 지나지 않아 상위법의 근거규정이 존재하지 않는 상황에서 운영되기 때문에 해당 제품군을 제조하는 업체가 인허가를 받기 쉽지 않은 것이 현실이다.
따라서 융복합 의료제품을 법제도 내에서 안전하게 관리하기 위하여 약사법과 의료기기법의 개정이 요구되는바, 본고에서는 약사법 및 의료기기법 동시개정 방안 마련에 선행하여 우리보다 먼저 융복합 의료제품에 대한 규제를 선제적으로 대처하여 규제하고 있는 미국의 사례를 살펴보고자 한다. 미국에서는 융복합 의료제품을 어떤 기준에 따라 정의 및 분류를 하고 있는지, 융복합 의료제품에 적용되는 법령에는 무엇이 있는지 살펴봄으로써 시사점을 도출하고, 융복합 의료제품을 효율적으로 규율하기 위하여 우리 「약사법」과 「의료기기법」이 나아가야 할 방향이 무엇인지 고찰해보고자 한다.

영어초록

Combination products refer to products that combine medicines and medical devices. Pre-filled syringes and drug-releasing hydrogel wound dressings are representative product groups that fall under this category. In Korea, laws applicable to medical products are divided into 「Pharmaceutical Act」 which applies to medicines and 「Medical Devices Act」 which applies to medical devices. The definitions of the two laws adopt a mutually exclusive regulation method that excludes each other from the scope of application. However, combination products have the properties of both drugs and medical devices. It is difficult to obtain permission as either a drug or a medical device product group in the licensing process.
In order to solve these problems, the Ministry of Food and Drug Safety created a rule called 「Regulations on Complaint Mediation and Handling Procedures for Convergence Medical Products」. The regulatory body handles approvals related to coombination products in accordance with the relevant regulations. But the regulation is nothing more than the Ministry of Food and Drug Safety's task process regulation. Because it is operated in a situation where the delegation clause of the upper law do not exist, it is difficult for a company that manufactures the product to obtain permission.
Therefore, in order to manage safely combination products within the legal system, revision of definitions in the Pharmaceutical Act and the Medical Devices Act is required.
In this paper, in order to prepare a plan for simultaneous revision of the Pharmaceutical Act and the Medical Devices Act, I will examine the case of the United States, which preemptively regulates to make the laws, regulations, and guidelines related to combination products ahead of Korea. I will investigate specifically what laws and regulations apply to combination products in the US, and derive implications by analyzing how the legal definition and classification standards of combination products are stipulated.
In addition, I will consider how to revise our 「Pharmaceutical Act」 and 「Medical Devices Act」 in order to efficiently regulate combinations products.
