개발부담금 징수율 제고를 위한 징수수수료 체계 개선방안 (Improvements for Collection Fee System to Increase Development Burden Fee Collection Rate)

초록

개발부담금은 토지개발사업에서 토지의 가치 증가분에 해당하는 개발차익의 일정부분을 부담금으로 환수하는 제도이다. 한편, 최근 개발부담금의 체납율이 높아 징수체계 등에 대한 문제가 제기되고 있는 상황에서 본 연구는 부담금 징수수수료체계에 초점을 두고 징수율을 제고하기 위한 개발부담금의 징수수수료율 체계 개선안을 제시하고자 한다.
현행 개발부담금 징수수수료 체계의 문제점은 다음과 같다.
첫째, 현행 개발부담금의 징수수수료율은 일괄 7%인데, 이 수수료율 인상에 대한 지자체의 지속된 요구에도 불구하고 현행 수수료율을 고수하고 있다. 이에 징수수수료율의 인상이 필요한 상황이다. 둘째, 징수 규모 및 징수율에 따른 차등적인 체계가 필요하다. 현행 다수의 징수율에 따른 차등지급체계의 기준을 적용하는 방식으로 인센티브를 부여하고 있다.
이에 본 연구는 다음과 같은 개발부담금 수수료율체계에 대한 개선안을 제시하고자 한다.
첫째, 징수율에 따른 차등적 징수수수료율 체계를 도입하는 것이다. 개발부담금의 기본징수율을 60%를 기준으로 4단계 초과누진체계로 4개 구간으로 구분하는 체계로 구성된다. 이는 높은 징수율에 높은 수수료율이 적용되기 때문에 징수업무를 수행하는 지자체의 징수율 제고를 위한 유인을 제공할 수 있다. 둘째, 개발부담금 징수 인센티브의 근거를 마련하는 것이다. 개발부담금 징수수수료의 용도에 징수율 제고에 기여한 우수 인력에 대한 인센티브 제공하는 방향으로 개선안을 제시하고자 한다. 셋째, 악성 체납액에 대한 패널티를 부여하는 것이다. 이는 체납액의 결손처분이 많을 경우, 악성 체납액에 대한 징수사무위임 업무에 대한 추가적인 노력 등을 들이지 않았다는 것으로 지급받는 징수수수료에서 이 결손처분액이 차감되는 패널티적인 요인이 적용됨으로써 징수노력을 독려할 필요가 있다.
이 연구는 징수율이 높을수록 높은 징수수수료율을 적용받게 되면서 징수업무를 담당하는 우수 조직이나 개인에게 인센티브를 제공하기 때문에 징수율 제고 유인을 높일 수 있다는 정책적 시사점을 제공한다.

영어초록

Development charges are a public utility fee collected for land development projects, and a portion of the development profit is recovered as a charge for the increase in land value. Meanwhile, as the delinquency rate of development charges has recently increased and problems have been raised regarding the collection system, this study focuses on the charge collection fee system and proposes an improvement plan for the development charge collection fee rate system to increase the collection rate.
The problems with the current development charge collection fee system are as follows.
First, an appropriate fee for development charges is needed. The current development charge collection fee rate is 7% across the board, so it needs to be improved to an appropriate fee rate.
Second, a differentiated system according to the collection scale and collection rate is needed. The current differential payment standard according to the majority of collection rates is generally providing incentives. Third, the current development charge fee collection rate is 7%, but despite the local government’s continued request for an increase in this fee rate, it has not been increased yet. Therefore, an increase in the collection rate is necessary.
Therefore, this study proposes the following improvement plan for the development charge fee rate system.
First, a differential collection rate system based on the collection rate is introduced. It consists of a system that divides the basic collection rate of the development charge fee into four sections with a four-stage progressive system based on 60%.
Second, a basis for development charge fee collection incentives is established. The improvement plan proposes adding incentives for excellent personnel who have contributed to increasing the collection rate to the purpose of the development charge fee collection fee.
Third, a penalty is imposed on malicious delinquent amounts. This means that in cases where there are many cases of deficit disposal of delinquent amounts, additional efforts are not made for the delegation of collection work for malicious delinquent amounts, and thus, it is necessary to encourage collection efforts by applying a penalty factor that is deducted from the collection fee received.
This study provides policy implications that can enhance the speed of collection rate increase because the higher the collection rate, the higher the collection fee rate is applied, providing incentives to excellent collection organizations or individuals.
