초록

리걸테크는 미국에서 법조문 검색, 증거목록의 작성, 소송기록의 정리 등을 사람이 아닌 인공지능이 대체함으로써 법조인의 편의를 도모함과 동시에 소송과 관련된 시간과 비용을 대폭감소시켰다. 또한 고객의 측면에서도 법률 서비스 이용의 문턱을 낮추어 적은 비용으로 법률구제를 받을 수 있다는 분위기를 확산하는데 크게 기여하였다고 평가할 수 있다. 특히 미국 법원이 소송의 절차 중 전자증거개시제도의 이행여부에 대하여 엄격하게 판단하고 증거개시 및 증거보존통지의 불이행이 있는 경우 막대한 금액의 과징금 부과와 손해배상, 나아가 승·패소 여부까지 좌우하는 태도를 취하고 있다는 점에서, 리걸테크는 이러한 전자증거개시절차의 성실한 이행의 필요성과 맞물려 미국에서 폭발적 성장을 이룩하였다. 이는 전자증거개시절차 자체가 복잡하고 까다롭기 때문에, 데이터 수집·축적·분석이 용이한 디지털플랫폼이 업무의 효율성을 발휘한 것으로도 이해할 수 있다.
국내의 시장상황도 더 이상 리걸테크의 발전과 성장에 무관치 않다. 국내 등록변호사 수가 증가하면서 경쟁이 심화하였고, 서비스 차별화의 필요성으로 리걸테크를 활용한 법률 서비스의 중요성이 확대되었다. 리걸테크의 변호사검색 기능, 판례검색 기능은 일반적인 온라인 플랫폼의 비대화 일반인과 법조인 간의 정보비대칭성을 완화하여 누구나 원하는 변호사들에게 서비스를 받을 수 있게 하여 일반 국민(소비자)의 법률서비스에 대한 접근성을 높였다. 또한 증거개시제도의 경우 이미 형사재판에서는 2007년 형사소송법 개정을 통해 우리나라 소송법에도 적용되는 절차적 제도이며, 국내 기업이 미국 법원에서 미국의 기업과 진행하는 소송이 증가하고 있는 상황에서 특히 전자증거개시제도의 충실한 이행의무는 미국 기업뿐만 아니라 우리나라 기업에게도 적용되는 의무가 되고 있는 상황이다.
미국에서는 이미 전자증거개시 분야의 Logikcull, 법률 자문 분야의 Legalzoom이 괄목할 만한 성적을 거두었다. Logikcull은 인공지능 기술을 활용하여 사용자가 업로드한 방대한 양의 데이터를 분류, 정리 및 태그를 달아주어 변호사의 편의를 도모하였고, Legalzoom은 변호사를 둘 여력이 없는 개인이나 중소기업에게 유용한 법률 서비스를 제공하여 큰 인기를 끌어, 대부분의 사용자가 리걸줌을 구독하여 그 구독료로 회사 수입의 상당 부분을 충당하였다.
국내의 상황을 고려하여, 리걸테크 플랫폼의 정상화를 위하여는 인공지능과 알고리즘의 기술적 성능뿐만 아니라 데이터 보호, 알고리즘 규제 및 준칙 마련, 관련 인프라의 확충(특히 공개법률정보의 확대) 등이 필수적임을 이해할 수 있다. 특히 윤석열 대통령 당선인의 대통령직인수위원회는 디지털플랫폼에 대한 자율규제를 강조하고 있는 만큼, 앞서 설명한 리걸테크 플랫폼별특성에 착안한 자율규제가 이루어져야 할 것이다. 결론적으로 리걸테크 플랫폼은 정보 검색 비용을 낮추고 변호사에 대한 접근성을 높이는 등 소비자 권익증진에 분명 도움을 준다는 점에서 소비자를 포함한 이해관계자의 권익보호와 리걸테크 플랫폼에 대한 규제가 적절히 조화를 꾀하여야 할 것이다.

영어초록

Legal Tech has drastically reduced the amount of time and cost needed to file a suit, while also enabling more convenience for legal professions by substituting human resources to artificial intelligence in works of searching provisions, making a list of evidence, or reorganizing lawsuit records and others. Moreover, from the aspect of clients, Legal Tech allowed the clients to get easier access to legal services, and as a result it contributed in spreading the atmosphere that it is possible to receive legal aid with low costs. In particular, Legal Tech achieved explosive growth in the U.S. with the need for secure implementation of the electronic evidence discovery system in law proceedings, followed by imposition of heavy fines, compensation for damages, and even effecting prevail/defeat if not complied. As the discovery of electronic evidence itself is complicated and complicated, it can be understood that the digital platform, which is easy to collect, store, and analyze data, has demonstrated the efficiency of its operations.
The domestic market situation is no longer irrelevant to the development and growth of legal tech. As the number of registered lawyers in the country increased and competition intensified, legal services using legal tech as a necessity for differentiation of services expanded. Legal Tech's legal search and case search functions have eased hypertrophy of online platforms and the information asymmetry between the general public and legal professionals in general online platforms, allowing everyone to get services to lawyers they want, and increasing access to legal services. Also the evidence discovery system is already applied to the code of criminal procedure through the amendment of 2007. Faithful execution of the digital evidence presentation discovery system is applied to domestic company as well as American companies especially since the increase of ongoing lawsuits between domestic companies and American companies.
In the United States, Logikcull in the field of electronic discovery and Legalzoom in the field of legal advice have already achieved remarkable results. Logikcull uses artificial intelligence technology to categorize, organize and tag vast amounts of data uploaded by users to facilitate lawyers, and Legalzoom has gained huge popularity by providing useful legal services to individuals and small businesses which could not afford to have lawyers, allowing most users to subscribe to Legalzoom and covering a significant portion of the company's income with the subscription fee.
Considering the domestic and international situation, for the normalization of legal tech platforms, not only the technical performance of artificial intelligence and algorithms, but also data protection, algorithm regulation and rule-making, and expansion of related infrastructure (especially expansion of public legal information) are essential.
Especially, as the presidential transition committee of president-elect Yoon Seok-yeol emphasizes self-regulation on digital platforms, self-regulation should be reached based on the characteristics of legal tech platform described above. In conclusion, since legal tech platforms clearly do help promote consumer rights by lowering the cost of searching information and increasing their access to lawyers, regulations on legal tech platforms should be properly harmonized.
