예산법률주의만이 유일한 해법인가? (Is Budgetary Legalism the Only Solution?)

초록

예산법률주의 도입에 관한 주장이 늘어나고 있다. 주로 국회의 정부통제기능 강화를 목적으로 미국식 예산법률주의를 도입하자는데 초점이 맞춰져 있다. 그런데, 미국식 예산제도가 무조건 옳다고 할 수는 없다. 우리나라의 경우, 2018년 국회에 제출된 헌법 개정안에 예산법률주의를 규정했지만, 정부의 예산법률안 제출권과 증액 동의권 제도는 그대로 두었다. 예산은 국가의 재정지출계획이자 수권법적 성격을 지니고 있어, 국가(행정)기관 간에 효력이 발생한다. 따라서 예산집행 관점에서 예산법률주의와 예산비법률주의는 별 차이가 없고, 재정민주주의 실현도 큰 차이가 없다. 또, 예산법률주의는 예산 운용의 경직성이 발생할 가능성이 크고, 예산과 정부 정책이 효율적으로 연계되지 않을 수 있다는 점에서 의원내각제 국가에 더 적합한 제도라 할 수 있다. 따라서 헌법 개정을 통한 예산법률주의 도입이 유일한 해법인지에 관해 근본적인 의문을 제기해 본다. 다시 말해 현행 체계(예산비법률주의)를 유지한 가운데, 재정 운용의 책임성과 투명성을 강화할 수 있으면 된다. 더욱이, 우리나라의 경우 헌법 개정이 쉽지 않다는 점에 착안해 보면, 헌법을 개정하지 않은 상황에서 예산법률주의를 도입하고자 하는 취지는 반영하되, 헌법 57조의 확장 해석, 국회와 행정부의 권한 및 역할의 명확화, 예산의 증액 및 감액 때 정부 동의, 재의요구 및 국회 과반 의결 등에 관한 담론을 형성해, 세부 대안을 마련해 나가야 한다.

The discourse surrounding the adoption of budgetary legalism in Korea has intensified, particularly with the proposition to implement an American-style framework aimed at enhancing the National Assembly's oversight capabilities over governmental operations. Central to this debate is the 2018 constitutional amendment proposal which seeks to preserve the government's exclusive right to propose budget bills and approve increases. Given that the budget inherently serves as both a national fiscal expenditure plan and an authorizing statute, impacting predominantly national agencies, the substantive distinctions between systems of budget legalism and non-legalism are ostensibly marginal with respect to budget execution and fiscal democratic processes. Moreover, the principles of budget legalism typically align more suitably with parliamentary systems, raising concerns regarding potential inflexibilities in budget management and the consequential inefficiencies that may emerge in synchronizing the budget with dynamic government policies. This study posits that the constitutional amendment advocating for budgetary legalism may not constitute the most effective solution for advancing fiscal accountability and governmental transparency. Instead, this study suggests that enhancing the existing non-legalistic structures could sufficiently meet the objectives intended by the amendment. Recognizing the complexities inherent in amending Korea's Constitution, the study advocates for a broader interpretation of Article 57, alongside a more precise definition of the respective powers and responsibilities of the National Assembly and the executive branch. Furthermore, the study underscores the necessity for meticulous consideration of alternatives that address budgetary modifications, fostering a dialogue on issues such as governmental consent, requests for reconsideration, and majority voting processes within the National Assembly. These measures could potentially enhance the democratic oversight of budget management without necessitating fundamental legal reforms. This approach not only respects the extant legislative framework but also promotes a more agile and responsive fiscal policy environment.
