초록

원자력발전과 관련하여 우리사회의 가장 시급한 현안은 원자로에서 연소되고 남은 사용후핵연료의 처리문제이다. 이 문제는 원전을 이용하는 모든 국가들이 당면한 과제이다. 전 세계적으로 사용후핵연료 관리문제를 접근하는데 있어서 고준위방사성폐기물 시설에 대한 사회적 수용성을 높여야 하다는 데에 공감대가 형성되어있다. 이 목표를 실현하는 방식은 나라마다 차이가 존재한다. 우리나라의 경우에는 사용후핵연료의 최종처분시설의 입지선정과정에서부터 공론화를 시도하고 있다. 공론화 제도가 법률에 도입되어 실무기구인 공론화위원회를 통해 시행되고 있다는 점은 매우 고무적이라고 할 수 있다. 그러나 동시에 심각한 사회적 갈등을 수반하는 사용후핵연료 문제를 해결하는 방식에 대한 사회적 수용성을 제고하는 것은 매우 중요한 목표이자 가치이므로 이와 관련된 의사결정절차 및 방식의 제도적 문제점과 그에 대한 개선방안을 꾸준히 연구하고 모색할 필요가 있다. 이러한 의식 하에, 본고는 2013년 제정된 독일의 「고준위방사성폐기물처분시설 부지선정법」의 주요내용을 중심으로 사용후핵연료 처분시설부지선정절차의 민주성과 그 결정의 사회적 수용성을 강화하기 위해 고안된 독일의 혁신적인 접근방법과 이와 관련하여 독일 내부에서 논의되고 있는 법적 쟁점을 검토하고 그것이 우리나라에 대하여 가지는 함의를 고찰하였다.

영어초록

The spent fuel management issue has become an important political, social, economical, and national agenda in Korea. As we have experienced with the low and intermediate level radioactive waste disposal facility in Gyeongju, this will certainly create serious and bitter controversies and conflicts in the Korean society in general, and among the residents in the potential sites, in particular. It is internationally and widely agreed that to increase public acceptance on the final disposal facility is the key strategy and the only way to deal with the spent fuel management issue, and the Korean government strategically took an initiative to publicly discuss and consult the high-level radioactive waste management issues with an amendment of the Radioactive Waste Management Act. Given the significance and importance of the spent fuel management in our present and future society, it should be noted that we better be a prudent observant in this matter and diligent in searching for better alternatives. Having this in mind, this article takes a close look on the German innovative path towards a final high-level radioactive waste repository, focusing on the Repository Site Selection Act of 2013(RSSA). In Germany, the political and legal endeavors to explore and establish a final repository for nuclear waste have a long and tortuous history extending over decades. Attempts to site repositories mostly have been abortive the latest example being the Gorleben site for a high-level nuclear storage facility. Presently, Germany is undertaking a new effort to embark on a site selection procedure on the basis of the recently enacted RSSA. This article first peruses the difficult history of the Gorleben siting, and then discusses main features of the RSSA as well as some legal issues related to this innovative approach to the procedural steps which have to be explored for many decades to come until a repository can be operative.
