공정거래법 위반행위에 대한 형벌의 정당성과 정비방안 연구 (A Study on the Justification and Improvement of Penalties for Violations of the Korean Fair Trade Act)

초록

2018년부터 2020년 사이 ‘독점규제 및 공정거래에 관한 법률(이하 ‘공정거래위원회’라 한다)’ 전면개정 논의 과정에서, 가장 이목을 끌었던 이슈 중 하나는 전속고발권 폐지 여부였다. 이는 공정거래법 위반행위를 형사범죄와 같이 사법행정기관에서 직접 수사하여 기소할 수 있는 길을 열어주는 것이어서, 시장과 사업활동의 위축을 초래할 수 있다는 우려 속에서, 매우 중대한 사안으로 취급되었다. 전속고발권은 공정거래법에 형벌이 광범위하게 도입된 것에 대한 반작용이고, 형벌에 부수하는 통제장치이다. 따라서 전속고발권의 폐지 이전에 공정거래법상 형벌의 정당성 문제가 더 근본적이고 중요하며, 선행적으로 논의될 과제임에도 불구하고, 전속고발권 폐지 논의에 밀려 이에 대해서는 충분한 관심을 받지 못한 것이 사실이다. 2020.12월 공정거래법 전면개정 결과, 우여곡절 끝에 전속고발권이 존립하게 되었고, 나아가 고발요청권과 의무고발제를 통한 형벌집행 강화 분위기도 없지 않은 상황을 고려하면, 형벌의 정당성 논의는 여전히 중요한 이슈가 아닐 수 없다. 이러한 배경에서, 본 고는 먼저, 공정거래법상 의무(또는 그 위반행위)를 그 내용과 성격에 따라 실체적 의무와 행정적 의무로 구분하여 각각의 특성을 살펴보았고, 이어서 형벌의 정당성 평가기준인, 보호법익, 죄형법정주의, 최후수단성 기준의 내용을 살펴보았으며, 끝으로 공정거래법상 형벌을 이들 세 가지 기준에 비추어 정당성 여부를 검토하였다. 결론적으로, 공정거래법상 실체적 의무위반행위 중에 이들 세 가지 기준을 모두 충족하는 경우는 찾을 수 없었다. 다만, 경성 공동행위가 이들 기준과의 부합도가 상대적으로 높게 나타났다. 한편, 공정거래위원회 업무 집행의 편의와 효율성과 관련되는 행정적 의무도 정당성을 인정하기 어려웠으며, 다만, 공정거래위원회의 현장조사에서의 조사거부나 방해와 관련된 행위에 대한 형벌의 필요성은 인정된다는 결론을 얻었다.

영어초록

During the discussion on the full revision of the Monopoly Regulation and Fair Trade Act between 2018 and 2020, one of the most notable issues was whether to abolish the exclusive right to file complaints. This opened the way for judicial administrative agency(prosecutor) to directly investigate and prosecute violations of the Fair Trade Act, such as a criminal, and so was treated as a very serious issue amid concerns that it could lead to a contraction in the market and business activities. The exclusive right to file a complaint is a reaction to the widespread introduction of punishment in the Fair Trade Act, and is a control device incidental to the punishment. Although the issue of the legitimacy of punishment under the Fair Trade Act is more fundamental, important, and pre-discussed before the abolition of the exclusive complaint right, it is true that they did not pay enough attention to it. As a result of the full revision of the Fair Trade Act in December 2020, the right to file a complaint survived, and considering the atmosphere of strengthening the enforcement of punishment through the right to file a complaint and mandatory complaint system, discussion on the legitimacy of punishment is still an important issue. On this background, this paper first examined the characteristics of obligations under the Fair Trade Act divided into substantive obligations and administrative obligations according to their content and nature, followed by the contents of the justification criteria. In conclusion, there was no case in which all three criteria were met among substantive violations of obligations under the Fair Trade Act. However, the degree of conformity with these standards was relatively high for hard joint actions. On the other hand, it was concluded that administrative obligations related to the convenience and efficiency of the KFTC’s law enforcement were also not justified, but the necessity of punishment for acts related to refusal or obstruction of investigation was recognized.
